Do I have to go with the notice of suspension or not???

I am confused whether to report on work tomorrow or not. I was served a Notice of Suspension for three(3) days from the HR Department, with the offense of disrespecting them. To summarize, I've got a wrong sent message to the HR Head stating some bad words, but it is not really intended for her. I was just shocked one day when the served me Notice to explain (NTE) the day before they served the suspension letter. I was trying to explain to them during my reply to NTE that it was not really intended for her. Now, I wrote again a letter of appeal regrding the suspension just this afternoon, but how can I?tomorrow is now the first day of my suspension until May 28...I stated in the letter that if won't be given a chance to have admin hearing, I have the right to seek for legal advise from the department of labor...I am really bothered..Few nights already that I cannot sleep during night. Please tell me, is what I have done is right or strongly not right?Please advise me and try to analyze my situation.

Well, that's a very unfortunate situation you've gotten yourself into. The HR Head received that message from you, even if it wasn't really meant for her. She has nothing to go by except for the message she received and your reaction to the NTE. It sounds like the message explained itself pretty well. From the HR department's standpoint, your explanation might look like a hasty and ill thought-out attempt to backtrack. With the economy the way it is in my country, sometimes threatening to seek legal advice results in an employee being let go by the company. I sure hope that doesn't happen in your situation. I think the best thing that you could do would write an apology letter to the HR department head. I know it's probably not something that you want to do, but a little bit of humility can go a long way in smoothing things over. If you take responsibility for sending the message to the HR head, even if it was accidental, it will reflect on you a lot better than trying to fight the suspension because the message you sent wasn't intended for her.

Yes this is really unfortunate, in fact I am performing well on my job but just this situation had bothered me a lot. I just want to ask one question, Do she has the right to react that way just because she received the wrong sent text message from me? Do she had the right to react that way by serving me the notice to explain because of that...that according to her I am disrespecting her or discourteous? OMG! Do I need to write an apology letter after all that they have done to me?I was trying to explain to them all the possibilities that might change their mind not to go with the suspension, but still they said its final. I was not even given the admin-hearing that I was asking for stated in all of my appeal letters. Do they really have the justifiable reason/s to suspend me from work? Please advise me. Thanks

You should know first what is your company's policy regarding this. You can talk with your boss and explain your side to him. I think before it should be imposed, the boss will be notify as well. They should hear your side first and with our company, you will be asked make a replay to the written memo then receive it or not. You will not be suspended just like that because everyone deserves a due process, unless they take it personal with you. That is what we have here, I don't know what is yours. I hope you can explain your side as well.

That's what I'm trying to ask from them....I am asking for the due process. They cannot just simply suspend me from work without prior conference or admin hearing. They tend to be one-sided. The HR head tends to be unfair and unjust just because she the one who is involved. I was trying to appeal, I even write a letter address to my big boss but still no reply at all. So what should I do?Today is supposed to be my 2nd day of suspension but I am here reporting on work, because I believe in fighting for my right, the right to be heard..not just through writings. This coming Monday, I am not filing for case of Illegal suspension, do u think this is the right thing to do for me?

you did the crime, you do the time. it doesn't matter WHO they were intended for, you are guilty of, as you put it, 'using bad words' so you will just have to wait them out. you can seek legal advice but i am sure they will tell you the same thing.

what crime are you talking about?please analyzed my discussion before giving comment. it is just a text messages that the sender was unfortunately sent to her. it doesn't have any name, or we haven't have communication...why did she reacted that way that infact, she doesn't even grant the admin hearing that i am requesting to.

I guest that the NTE will explains your side. Go to your HR department immediately and appeal that it was not meant to other co-employee or you will be guilty if not, nevertheless you should learned also your lesson from this, a workplace is for work and not to make a bad relationship with co-worker. By the way why you need to send a bad words letter to someone like that?

Yes exactly the NTE allows me to explain my part but even if I've gone far with the explanations just to let them know and realize that It was not for her (HR Head) she still go with suspension. I would never let them destroy my record for all the years that I've been working for almost 5 companies now. I have been sending to them even to the top management some letters of Appeal but still it doesn't work at all. We are now in the level of filing a case. Because they ignore all my appeal letters, even asking from them the admin-hearing,then they just let me decide to file a case of illegal suspension at the National Labor Relations Commissions.
