Today my daughter said that if someone orders a sub, then dont wantit, or dont pick it up, she gives it to the employee thats there. and marks it as a mistake. she said shes not really supposed to do that. shes supposed to throw it away according to the rules! She said that lots of places like McDonalds even lock the trash containers from people dumster diving. I could not believe my ears. businesses are doing this she said because some have gotten sued from people getting bad food from the trash??!! how crazy is that? people going hungry and our world deliberately throwing away good food because the law allows this? No wonder this earth is going to h$ll!! I was so mad. but not much can be done i guess except for people like my daughter that bends the rules a little.

I've heard from Old Navy employees that if a item of clothing is even a little bit damaged, they have to cut it up and destroy it completely so that no one could sell it or wear it. I was completely appalled! I can't believe a cooperation would do such a thing! It's so arrogant and wasteful. I had no idea that it would happen in food chains too, and if possible that makes me even more appalled. Why would people allow so much perfectly good food go to waste? People are hungry and wearing rags, and companies will destroy good resources just cause they don't want to get sued? That's just outrageous.

i think lots of law suits are totally rediculus. they should not let people sue for something that dumb or at least not win it. why i wonder could they not sell their clothes cheaper that gets flawed as a second or something? i thought there was places that sell seconds.

Me too, but I just can't understand why big companies do a number of the things that they do. It really breaks my heart that all those good foods and clothes could totally go to waste like that.

That is really a shame. Not much we can do when the law is in their favor. Pretty craxy dumpster diving for bad food. Wasing food is horrible. My grandmother would turn over in her grave hearing this. You should be proud of your daughter and I hope she doesn't get in trouble for doing this.

http://www.neatorama.com/2008/07/01/eating-expired-food/ I had read about groups who were collecting supermarket items on their due to expire dates and distributing them to charities..couldn't find a link for the practice,or what charitable efforts were getting these donations..the link is an article on such food, and has a bunch of comments from people who have (Willingly or unknowingly!) eaten expired foods..

The thing with Dumpster diving (I've also heard it called "Freeganism!) is that stores will dump items that are still perfectly edible,it's just the expiry date on the pack has been reached, and they're not allowed to keep offering it for sale after that..Lab tests on "expired" items have shown they're still good to eat with no harmful bugs on fresh items for days afterwards,if not over a week..and that's not including items made with preservatives or in cans..

yes believe it or not, Subway has my daughter throw out outdated sodas in bottle, and chips in the little packages. so, at times she sneaks those home also. now that really dont make sense to throw those out but i guess they have to make sure the expire date is not expired.

You can see their point if someone would sue after scoring a free sandwich while Dumpster Diving..Working in a Hotel,We're not supposed to offer "Doggy Bags" for the same reason..sammich ingredients can quickly become breeding grounds for bugs that thrive on warm, nutritious stuff at room temperature or higher ,say on a car trip home..next thing, food poisoning is an issue, and the last thing a food business needs is that becoming public, whether the problem was in house,or the result of bugs incubating into an incident on the way home..I too don't like seeing good food going to waste!

It's this claim culture thing that's going on and the "No win,No Fee" Lawyer representation..You take risks going about your daily life,at home and walking out the door each day..but some think somebody ELSE should be responsible for them taking that risk...and that's what leads to this situation..

you are right. to many people these days thinks the world owes them something and its all about them. so they go to a lawyer to get them something for nothing. gone are the days when you couldnt get something for nothing. some people dont have to work for anything.

i can see their side of it. i think the law has just went way off when it comes to such things. there should be a better way. like a clause in a contract for homeless shelters to sign or something so it can go there.

yup.i know a few people who work for deliveries who do that. especially pizza places. some states it's actually against the law to donate food in any way shape or form. or doggie bag it,such as my own.mainly because of lawsuits. that's one think i hated about working banquets-when you had to tell a $50K wedding party they couldn't bring food home.and of course they'd get pissed, and yell for my manager, who'd tell them the same thing,it was against the law.

yup.by law,you can't reuse food either even if it hasn't been touched. although,i've known places to do it on the sly anyway, but they'd be busted if the health board found out.

In my younger years i alwyas got stuck working in food places. We also were supposed to throw unwanted or unclaimed food away but instead gave it to employees. Thats not really a new thing. There are also a lot of non food business that lock the dumpsters. Reason being some people who dont have garbage service coimg to their houses will drive by business and throw their trash in the business dumpster. They call it theift of services.

I see videos on you tube where people will go around digging in dumpsters to hunt for good foods that the stores throw away. I remember a few years ago i was looking for boxes in dumpsters and i ran across a box that had a lot of berries of all kinds that they had thrown away. Some veggies too. I took them home sorted, rinsed and froze them.

dear bunnybon things are not better over here. I heard a story about a woman working in a cafeteria, they served fried fish fillets for lunch that day and cause one piece of fried fish was not sold she wanted to take it home. She was caught and fired. Or at the place where my husband works. They get the food from a caterer but if there are left overs they are strictly forbidden to take these home and the perfectly good food is going into trash. It angers me the same it angers you. Theres nothing wrong with a sandwich which is freshly made and just not picked up. Or in case of McD there wouldnt be anything wrong with a few hamburgers still waiting to be sold when the place closes if they were given to poor people or the employees could get them for half price or even for free. But noooo the good stuff is again dumped into trash. you are right the world is going to H3ll and too much food is wasted.

When I worked in an ice cream place, we were supposed to do the same thing - throw items out. Usually we just kept them in the freezer in the back and let anyone take what they wanted. Same went for frozen pies and cakes in the case. I don't see what the big deal is as long as the food itself is still good.

yes, when i worked for my aunt in a restaurant in the 70's, they gave the employees all the day old donuts, and 2 day old pies left, etc. she also would not allow food thrown out.

It is a shame. We have a friend that drives truck for a food company. He mainly hauls cereal. He brings us cases of cereal that the company puts out to the dumpster. If one box in the case is damaged, they throw the whole case out. How crazy is that. The employees can get them if they want, but they will not give them to soup kitchens or anywhere like that. I take what he brings me and pass them out.

way back yrs. ago that worked also. i remember the chips factory was right down the street from us and one day a week they would toss out bags of chips and trash bags just filled with chips from the machines that werent in chip bags. us kids would show up there and grab what we could carry and no one said anything

It's a shame what companies have to do to avoid frivolous lawsuits. There was a time when 'mistakes' were routinely given to employees, or even donated to homeless shelters...at least where I used to live. Not sure about my current state. Companies not only have to protect themselves, they are also in the long run protecting it's customers. When these stupid lawsuits are won, who do you think pays for it? It's passed onto the consumer in higher prices! You just know some one has ordered a burger through a drive thru, gone to the dumpster and found a spoiled one, and sued claiming that the spoiled one was what they were given.

I know what you mean. I have seen places throw away enough food to feed an army. Especially those buffet type places. I can see the legal side of it as far as handing it to them but they could create a release form for people to sign if it is that big of a deal..you know? There are ways around throwing a ton of food away while the world is hungry.

I know someone that almost got fired for doing something similar. The company was throwing away things that were perfectly good and could be recycled, such as cabinets and light fixtures, but they were "obsolete" and being replaced with new ones. My friend took some of the trash items and used them for his family. The company found out that he was doing this and said he was stealing, and they told him that if they found out he did it again then he would not only be fired but also prosecuted for theft, even though the items were going in the dumpster anyway.

That is exactly what my friend told the company ... that they could donate it or recycle it in some way to benefit others or to maybe get a little extra money for their business. They did not care to do either, but they still insist that the things they are throwing away are their property, even if they are in the dumpster. I know that my friend will not take anything else, but what about other people that see the perfectly good items in or next to the dumpster ... is the company going to try to prosecute them if they decide to take them?

That is corporate america at work. They claim they need to make more money so they raise the prices. But on the other side they are throwing away good food like you said instead of letting the employees take the mistakes or subs that were ordered and no one picked up. It is a waste of money and food. I believe this goes on with all these fast food places. And it is disgusting that a store can be sured for having bad food if it were taken from the garbage. I am amazed and not amazed at the same time. I would have done what your daughter did. Why let it go to waste. Or I would have taken it home for someone in my family.

she has done that with cookies and also the outdated soda bottles, and chips. but hard to get past the higher management. its rough for a child that grew up with only a certain amount of everything and not always everything we needed. it was pure stretch and budget with us. sometimes they only had potatoes, ketchup, peanut butter and bread and some ramien noodles available. food but not what kids always want. she knows about not having food as sometimes her friends would eat at our house even though we were a bit poor back then. i always made sure they had some food and a shelter before anything else. so shes quite thrifty except when it comes to that loser she has and she will go without anything for that one. probably why she likes to live with mom. she knows if i got it shes got it

I understand your feelings on her boy friend. But lots of people do that for their partners. I have always tried to have some food around when my kids come for the weekend. Since they are still young, they are easier to please with food. But I always give them the option. I don't mind they eat some of those frozen foods, but for the most part they eat home cooked meals. The other stuff is fillers. Like snacks. But I try and discourage that.

I worked at a fast food place called Checkers and it was the same way there. If something got messed up and we were caught eating it it would be taken out of our pay whatever the cost was of what we ate. To me, I would much rather someone eat it than for it to be thrown away! That seems crazy to me too!

I worked at a food place as well when I was a teenager. Fortunately, it was a small business, so the owner and his wife worked there much of the time and often took the call-in orders, which were usually the ones that were "messed up", because sometimes people would call in and then never come to pick up the order. If this happened, then the owners would generally let one of us have it if we wanted it, because they would rather us eat it then it be thrown away. That seems to me to be the best way to handle it, and I think that they could do it like that because they were just a small family owned business and knew all us employees.

It's not just restaurants and grocery stores that throw a lot of food away. I remember a year or two ago when the government wanted to cull a lot of geese that have become a nuisance. Someone suggested they use the geese to feed hungry people, but the government said they couldn't. So many people sue over little things, even things that are their own fault. Even if they won the lawsuit, it is so expensive being sued that they would rather avoid litigation.

i do understand the side of the restaurants and such. but something needs to change. today its harder to live and feed everyone then it was back in the 60s and 70s and back then, stores could actually put things in a sale ben that was out dated to get rid of it for just a few cents. restaurants could toss the food out and anyone could come by and pick it up if they needed it.

Your daughter will be fired if she gets found out. The business have to conform to the law, it is the same way here in Canada. There are no solution that will make everyone happy. If restaurants lose money over being sued that means people like your daughter lose their jobs. Governments make these rules and companies have to follow them.

true and lawyers have just made it worse since so many have taken crazy cases and some how won. like with the case of the woman sueing McDs over hot coffee spilling in her lap. that was her own fault. we are supposed to expect coffee to be hot. next thing someone will sue cause their coffee was to cold!

Buisnesss have been doing this for years. There was a bakery beside my store & they threw everything away that they didn't sell everyday. I was like u, i thought it was awful but was told they were not allowed to give it away. If i had a food place i would let the employees have it if they wanted it but guess they get tired of it working w/it all the time.. I hate to see food wasted. That's on e thing i don't do, costs too much to waste it.

I have heard of this so many times in my life and it is something that really makes me upset because I know that there are people everywhere that aren't able to feed themselves on a regular basis. Now, I don't think that restaurants should just hand the mistake food out to everyone that walks into the store. However, I think that they could keep a bin and fill it with the mistake food during the day and donate it to a homeless shelter or food bank so that people would be able to eat instead of wasting the food.
