Should mentally ill criminals face jail? Or be hospitalized??

With all this talk about the shooter from Colorado whom dressed himself as the joker, walked into a midnight showing of the new Batman movie and opened fire.... It has me wondering. Should a mentally ill person be jailed or hospitalized? This shooter is 24 years old and was previously studying for his PhD in neuroscience. So.... he is obviously intellegent. But he would have to be mentally ill to commit such an act. He ended up killing 12 innocent people and injuring 54 others. Obviously, he should be punished.... Right?? Of course, I beleive this man should be punished, if only to get him off the streets. But, I also think he should be forced to see mental health professionals. Of course, for his own good but perhaps, we could figure out what snapped in man and perhaps we will be able to see warning signs and prevent others from doing the same. I badly want to know how a person goes from studying for a PhD in neuroscience to being a murderer... I mean, he died his hair and dressed like the joker and brought his own gun so he surely knew what he was planning.

I think this guy should be put to jail because he is a smart criminal and he no dumb man. He is capable of doing anything and such people should be punished. He had killed so many people. it is just like wanting to gain fame by doing such criminal act and them acting mental. this is crazy. he should be punished with no mercy. thanks for sharing and have a wonderful day.

its really hard to know if these people are fit to stand trial. even if doctors study him, it is still their own opinion what punishment should follow. i think if he needs help, he should get it. there are places that can help him that can still be defined as punishment like a criminal section of a metal hospital.

You couldn't be more correct. I really like the phrasing you used... Is this man 'fit to stand trial'? We have seen in the past where teenagers were committing similar violent crimes, running into their schools and opening fire on classmates. In some of these cases, the shooter was experiencing extreme bullying in school. A person can only take so much, especially a teenager. Now, I am not condoning this behavior, but my heart just always went out to these people. It is sad. But to determine if someone as bright as the Colorado Batman shooter is 'fit to stand trial' would be tough. Even under extreme observation it would be hard to determine if a person is truely mentally ill or acting as if to save their behinds.....

hi, yes, he should be punished, he know what he is doing, such people are very dangerous, he may have big degrees under his name , but if he feels he can do anything and show his intelligence then that's not done, let him sit in the jail, and suffer.

Only the doctor can tell. Ordinarily, we cannot tell if a person is mentally ill or not. They maybe ill, but how about the victims of the crime? their families? Personally, I am not against the medication of a mentally ill person but he should be penalized for the act that he has done.

In my own opinion if they found out that he is mentally ill better to put him in the mental institutions or hospital to treat him and for his own and inmates safety reason. When I am doing my hospital duty in a mental facility most of our patients are mentally ill and all of them has a case like murder, theft, homecide,rape and etc. but I think they deserved a treatment so that they can able to face their case and pay for they have done.

He should be punished severely for what he did. He was studying neuroscience. He knows enough to fake it and get away with it on the grounds of insanity. Marissa Randazzo, former chief research psychologist for the U.S. Secret Service and an expert in mass shootings said on Good Morning America "Let's keep in mind that he was studying neuroscience. He was studying exactly the type of brain issues that we're going to be talking about throughout this whole case." Maybe he planned it as an experiment to see if he could get away with it by feigning insanity. It's been done before. They may be able to give him a brain scan, as the brains of serial killers and persons with certain disorders have distinctly different brain patterns than the norm. Bottom line I think he knew what he was doing. And should be punished accordingly.

This is a tough one but great discussion idea. I would have to say for observation purposes he should be hospitalized, my hope with this would be that we get some answers on this persons mental state and even gives us ideas on signs to look for in those who are mentally ill.

The guy is so intelligent that he knows very well how to fake being mentally ill. He's extremely cunning and took such precise care in planting the bombs and doing the shooting, that he would certainly have prepared what to do when he would get caught.

Many if not all psychopaths and sociopaths are very intelligent. Yes, he should be punished. I think hospitalizing someone like this is the best route to take. It both helps him and helps professionals to better be able to see warning signs in the future. I can partially understand the pathology in this. People like this fastasize for a long time and may even being doing some bizarre things but are able to stay just under the radar for long periods of time. But do finally snap when something like that test he failed comes about. Ofcourse he knew what he was planning! He had probably been fantasizing about it for months. See people like this do not see people as humans. They see them as pawn in their little game and they have no feeling for them at all. Just their use in their plan.

There are psychopaths who are also extremely intelligent and plan their acts very carefully,such as the Colorado shooter or Andres Breivik,who caused the massacre in Norway last year;it is obvious that they have serious mental problems,but this doesn't mean that they should be placed in a mental institution.They belong in jail and they should never be free again.The problem with such individuals is that they are so clever that they manage to deceive everyone;we might have such a psycho as our neighbor and never suspect anything simply because they don't show any signs of the criminal behavior they have in mind.Anyway,studying the minds of these criminals is probably very beneficial for scientists in making them understand what's going on inside their brains and maybe prevent others from doing the same,but I'm afraid there will always be individuals who will escape undetected and continue to cause tragedies and kill innocent people with no remorse.

from my personal experience with other people I can state that IQ is no guarantee for a correct social behavior. On the contrary, a person with a good memory and high IQ usually tends to show much less emotions and is only too often very anti-social when it comes to dealing with people of a lesser IQ. That is based on arrogance and the belief in infallibility. Such ppl remember things much better than others and therefore they know how to take advantage of many things, especially taking advantage of better paid jobs. Now, if someone wants to become a member of that ''elite'' but turns out to lack certain abilities or is not 100% reliable (e.g. only 50% of the time high IQ) or for some other reasons might represent a problem (e.g. a libertine) the whole caste surrounding that individual will make sure (s)he feels unwelcome and leaves the ''club''. Unfortunately that doesn't always work. Some get really angry about the unsocial behavior of their pals. If this goes on for months or even years an otherwise normal person (like you and me) may turn into a Joker. Without knowing much about that particular guy you mention (I don't know much more than you have written) I would suspect that something like that happened there. Then we also have so-called sociopaths. I think when a person has been brain-f*cked (sry for the expression) by his parents, his surrounding etc. at an early age (i.e. in the childhood) there isn't much chance the person will ever change again. That's why Nazis or fascists try to lure young people so they can make sure they'll be obedient for the rest of their lives. Actually most people tend to be brain-f*cked nowadays in one or another way but that doesn't make them necessarily dangerous (under normal circumstances). But as we've seen in WWII a lot of people can turn out be dangerous by supporting an ideology that is able to murder millions of people. I know a few of the more dangerous sociopaths. Imo they should be jailed or at least be continuously observed. However, the issue here is, the wrong people are in the respective positions to do that observation and what is even more problematic, the wrong people are observed. A bit more pointedly put one could say it's the other way round: sociopaths observe kindhearted and benevolent people. For a (number of) reason(s) of course.

I definitely think he needs to be punished somehow too. But I also do agree that he somehow needs some form of medical treatment or hospitalization. I don't really know much about prisons or anything like that, but I think they should have a mental health facility so the mentally ill patients can be admitted while in prison. I don't think that just because a murderer is mentally ill they should just be given the mental health treatment and then put back out in the world. They need to receive the punishment just like a murderer would who didn't have a mental illness. A murder is still a murder even though he's mentally ill, he had put a lot of planning into this and even booby trapped his apartment.

I feel he is an intelligent criminal, who wanted to fake his intelligence and disguised as joker killed many people. He should be punished rigorously.In such case it becomes difficult to find if an individual is fake or is really sick.
