I saw the notation come across a post on FB and before sharing had to do a lil snooping. My jaw about dropped when I saw this headline http://news.yahoo.com/rapists-claim-child-custody-visitation-rights-31-states-223050024.html I commend anyone who has been thru such an experience to carry the child to term and those who also keep the child. Let alone in 31 states one has to worry about the perpetraitor seeking visitation and custody! Just to manipulate their sentence with the judge or parole board. How can this be allowed? Should the courts be able to force someone to allow visitation to a child created via rape and cause the Mother/Child further lifelong distress?

I can understand visitation rights for someone ACCUSED of rape, though I don't like it. But I'm really failing to see any logic whatsoever in continuing those rights after the accused becomes convicted. The way I understand it, they are not actually given a guarantee of visitation, but in those 31 states they have a right to request it. Chances are, if convicted, they will never get visitation. However, there is still a chance they could receive visitation as it's up to the courts, and in any case, the person raped has to visit the issue again. This is preposterous!!!!

hi 3snugglebunnies That is preposterous indeed a person jailed for
rape even thinking pf visitations rights or custody. That's just
ludicrous to me.Yuck there should never be any rights for a rapist in regards to a child cause by his raping the woman. He is the criminal and should not have any rights to anything. The courts should never be allowed to force a woman to let the raper see his child at all

I think that a rape conviction should automatically terminate the rapists parental rights. But what do you do with an accused rapist when they weren't able to get a conviction?

I want to say no, especially if the only reason is to avoid jail time or shorten a sentance. But then again I have to wonder if the mother is going to go for child support. She has every right to child support.. but my question is is it okay for her to take child support from him but deny letting him see the child?
I had this own problem myself, though technically I was not raped. I was only 16 and he was 32 and many consider this rape even though it was not against my will. But that's beside the point.
I went for child support when my son was around 5, though I don't get much. He's supposed to pay $50 a month but I get random payments in the summer here and there. He's usually very far behind.
I heard about a year ago that he was trying to contact me, but I did not want him to do that. He's very upsetting when he calls me. All he's ever done is try to get out of this somehow. When I was pregnant he tried to tell me to give the child up for adoption. Then when I went for child support he asked if we could avoid the courts. He'd send my son cards sometimes, but he doesn't really want to be a part of my son's life. (He was married when my son was concieved). I'm sure if he contacts me again it will just be to try to figure out a way out of paying child support or being responsible for what he's done.
But, do I really have the right to say he can't contact me if I'm still expecting child support payments?

I think they should not allow the rapists to do that at all.. since being raped is a very traumatic experience.. and seeing the rapist again would do more damage and bring back lots of bad memories.. Although i guess the child would look for the parent.
