This contract is bugging me...

This is the content of our new contract. Contract Type : This is Self-Employed System. For Employee: This company stays in Korea, so each employee has their own responsibilities themselves for social securities and withholding tax. This contract is self-employed, so it is not controlled by Filipino labor code. Here employee means on-line Tutor or local manager. All Applicants directly make a contract to Korean on - line Agency through Web-Site. All employees as on-line tutor work according to their contracts. If Korean-agency does not provide on-line students and on-line Tutor has no class, contract is terminated. All employees shall follow local manager's instructions for their works. Share System: This is Home Based On-line Tutorial System, but for the easy way of works, all employees should join the share system, through the share system all employees can share the back-up line internet to avoid internet no signal, generator for brown out. Each Local Manager should properly provide and help share system and common working place for share system to all on-line Tutor employees. For Local Manager: The Local manager just assists and helps all of on-line tutors to do their works well. He has no responsibilities for this contract of each on-line tutor. He only helps and guides computer system, recruiting, training, how to contract to Korea-Agency and salary-distribution for each employee. Each Local Manager should properly provide and help share system and common working place to all on-line Tutor employees. Work and Pay system : We exchange Filipino Holidays with Korean Holidays. If there is no work, there is no pay. Working Rules : 1. Not to be late for duty time unreasonably 2. Not to be absent for duty time unreasonably 3. Keeping English Speaking Zone in your working place 4. Not to use computer privately ( e-mail, sending message, face-book and social networks, etc.) 5. Not to use cell phone during class time privately 6. Keeping cell phone to be called by manager This will be printed out, employee sign here and Local manager keep this paper. We are in the Philippines and he's also in the Philippines. Would I sign this contract? What if he will force me to sign it? I'm troubled again. My days of having no stress ended. I think the best is to ask a lawyer regarding this contract prior to signing. I was also asked to sign a contract by my boss from Australia. I was just working online for them. I sent a copy of the contract to a lawyer and saw saw flaws with the contract as not all written is applicable in the Philippine set-up especially with the taxes and other obligations. When i pointed this out to my Australian bosses, they modified the contract and was then acceptable.

But my boss did this contract on purpose. He wanted it this way. He doesn't like to have ties with us so he wrote "he's only our local manager." I guess our days are numbered. He can terminate us anytime he wants. Thanks for posting and happy mylotting.

Hi Angel! I would like to know if the Korean has the permit to open a business in our country. Because if so, then they should abide by the rules of our country. If you agree with the contract, then you have to sign it but if not, there's no way to work with a company. The way I see it, this contract only favors them. Have a nice day!

Thank you so much. I think my boss only made it. There's no witness when signing the contract. There's no term or validity of the contract. It's just that. He's saying that our boss is in other country but our clients are paying them directly. I guess we have to prepare ourselves in finding another job. Thanks for posting and happy mylotting.

Personally' this would not be the type of place I would not want to work, for, because in reality with all these demands, it would begin to make me wonder what is next. But in reality this would be something to really think about as to what your best decision for this job needs to be from here.

The contract is obviously made by a Korean, its hard to understand, and it is a one way contract, the Koreans are playing it safe and this is really what happens when you get employed by them, this company is not stable, so i suggest that you do not sign the contract. Find a more stable company who can offer more job security and benefits.

Well i can understand your situation very well and i know u must be very much confused at this point of time. to be very honest, we all might give u suggestions but at the end of the day u have to take your own decision so take your time and i am sure u will take a correct decision very soon. After posting this discussion, he approached me to sign this contract in our website. I told him that I'll sign if I'm not busy. Oh my. I don't want to sign this but I guess I don't have any choice. I hope more myLotters will post their advice. Thanks a lot for posting and happy myLotting.
