Is troll face copyrighted?

I would like to use trollface on my website, and i know that creator of trollface sued reddit for use but i couldnt find info if he won. So if anyone knows what happend and can i use trollface on my website i would really appreciate it. Thanks :)

Every picture or piece of graphic art is automatically copyright unless the owner of the copyright specifically gives permission for others to use it.
Wikipedia has had to withdraw the image from their pages because the owner's permission to use it wasn't given.
The artist and owner of the copyright is a person named "~Whynne" and the image is marked as "Copyright" on his Deviant Art page:
If you want to use it on a web page, you MUST contact the author for permission otherwise you will leave yourself open to legal action. If you use it without permission (and even if you include the copyright information), you are breaking the law.

The answer to your last question is No. Saying it's owned by the public just because it got popular around the internet is a bit silly.
