We first need to discuss what medical malpractice really is. It's when a person in the medical professions doesn't stand by the normal and ethical treatments and procedures, when treating a patient. The best way to determine this is by asking yourself or the professional one simple question. "Would they do the same thing under similar circumstances, if asked to repeat the procedure?" If the person didn't use strong ethical practices and would not do the same thing over again, chances are pretty good that malpractice has occurred.
How often does this happen? It happens more often than most people realize, but not enough to really cause permanent damage to those who make a career in the medical field.
HOW CAN YOU DETERMINE IF THE PERSON WAS NEGLIGENT
There are a few ways. Did the situation cause bodily harm and/or injury? In spite of popular opinion, not every bad experience qualifies as medical malpractice. Sometimes it's just a small mistakes. Let's face it, mistakes happen. They happen all the time in the medical world. So you need to determine if there was any sort of injury first, before you move ahead with the claim.
If the person has apologized for it in the beginning, this could avoid some issues down the road. Most companies want to settle with the person, not the other people involved. If you can settle with an apology at the very beginning, this will be a major positive on both sides.
Sometimes the doctor has gone through it before. So in an effort to be totally honest with their patients, they may disclose this mistake at the beginning. They may feel as though they have done something wrong, even if they haven't. So you also need to determine if any wrongdoing did actually occur, or if they are just using the disclosure portion of their oath.
