When a Company Doesn't Allow The Woman Employee to Get Pregnant

In Indonesia, there are many companies that have job contract which not allow their woman employee to get pregnant on their 1st - 2nd years of working. For them, it's a big loose to have pregnant employee at early years because pregnant employee will have less productivity -their stereotype- and the company will have to pay salary for their maternity leave ( maximum 3 months leave ). As woman, I actually feel it's not fair. In my company itself, new woman employee doesn't allow to get married & pregnant in their two years of working. If the rule was broken, it's not only they get fired, but they must pay fines approximately 12 x their average salary per month ( 12 is number of months a year ). Cruel? Yes, but that's rule. Many companies usually will apply this rule for their first years of working only. In that time, I agree with that contract because my husband agree with it and we will plan the baby when our first daughter at 5 years old -yes, 2 years later ( I know how sometimes pregnancy is inevitable ). More than that, it was a great job for me and I can't stand anymore with my old job. I don't know if this rule is normal or weird or only in my country. Does your country have this typical weird rule for the employee? Do you think it's normal rule?

In our office we don't have that agreement . However , we have a casual period of 6 months and a probationary period of 6 months . With these respective contracts , the married woman tries not to get pregnant until she knows that she will be a regular employee already once she passed the probationary period .

I understand that company will count every lost and outcome from an employee I think the rule is fair enough

That's very tricky @SIMPLYD. Woman would not like to sit on that kind of situation. It's ironic how marital status will affect woman's career a lot

Oh wow, that really is unfair. Well, it is fair for the companies and back when my mum was pregnant she had to quit her job for staying at home with me. That was 30 years ago. Now we do have better and far more "social" laws in Germany. And not enough children *lol* Anyway, this kind of contract would not be possible here. I am really interested in reading what other members from other countries are writing about this

I am surprised to hear about this type of terms and conditions for female employees. I think it is discriminatory and unfair. Once a female employee gets a job, she may marry after few months and there is every possibility of getting pregnant after marriage, so it seems ridiculous terms and condition to me. If she happens to join such a company and signs such a contract, she will remain under immense pressure not to get married (if she is unmarried) or not to get pregnant (if she is already married). I am not sure if Indonesian Government could do something about it, if someone raises her concerns about this kind discrimination. In India as far as Government sector is concerned, rules about female employees are very favourable. If she joins Government service say today and next day she wants to avail maternity leave for 180 days, she will be granted leave with all the benefits. I have not heard any such condition in private sector companies in India. I doubt if any private company insist on signing a contract/agreement about getting pregnant in the initial years of service. However, a female employee needs to choose between her career and married life/family herself. If she want to remain in the private company, she may avoid getting pregnant till her employee confirms her in the job.

@redvakaurvaki - I think the Government of Indonesia and the private employers should look into the matter and should be more considerate towards women employees.

@dpk262006 Actually government has lost their integrity in front of us. They can't solve minor issues and now our political situation is very bad. I'm not sure they are sensitive enough with this issue

That's situation in our country. And I thought once that India may have similar situation like in our country -because we are Asia. It's really good how Indian government really take care of woman employee and protect their right. It actually makes us insecure, but yeah, sometimes we have no choice. At the same time, we need the job. So, though it's ridiculous terms, we just have to do it for some times until we have better financial

Actually I feel jealous because Mylotter from other country show their surprise on this regulation. Even Malaysia, our neighbor country, knows better how to protect woman's right at work.

As long as an organisation does not break rules pertaining in that country sadly they do impose such rules. It is left for women to opt out of taking jobs in such firms.

You're very lucky @bhabycatch013 to not have to work. It's very unfair, but yes, in my country Indonesia, this is not something new. I would love to resign after my contract period is over so I could enjoy my role as mother at home. I hope I'm ready for that in following years

There is no rule like that in my country (USA). It is against the law to fire a woman because she got pregnant.

When I first read your title, I just think it's ridiculous! I haven't read or hear any rules about this in my country, Malaysia. I As as @rusty2rusty, I think it's against the law to fire a woman because she's pregnant. But, I am not sure if a contract like this is acceptable. Whether or not I am married, I don't think I'll accept this contract, as I think it's against the human rights.

Even in Malaysia it doesn't happen -I'm really jealous. That's indeed ridiculous, &kaka135. You must know how bad regulation in our country -because Malaysia is Indonesia's neighbor. Our government seems don't really care about it

That really sucks. The company should have no say over when (or if) a woman can get pregnant. It's none of their business.

Unfortunately, it's not something new in our country @kataomoi. That's suck indeed, but many companies do this regulation because they don't want to lose. Even worse, government seems not care with all of this
