Child Visitation

Is it true in Georgia, that if you let the father take his daughter out for a play date and he do not bring her home he can legally keep her. I would have to go to court to get her back if there is not a legal agreement set up?

Depends. Are y'all married? In Georgia, if the child was born out of wedlock, then only the mother has custody rights. An unwed father has no parental, custody or even visitation rights at all. Not even if he pays support or signed his name to the birth certificate. He has to go to court and file a legitimation action during which he can ask for those things. Check the Georgia division of child support services site. They have links to all sorts of legal info there. I'd have the police on him and if they won't do anything, get a lawyer involved.

Yes I agree with Yuki you b es see a lawyer who is well versed in these matters so you will not run into those problems some lawyers wil help you pro bono meaning free of charge good luck God Bless

That depends on a number of factors, including whether or not he is named on the birth certificate. Your best bet will probably be to consult a lawyer who's well-versed in family law matters. Many will give free consultations.
