I was listening to the debate that Barkha Dutt held.
Problems with surrogacy in this country
a. Only the poor women let others hive their bodies;
b. Surrogates do lose respect in this society, and some are not accepted back even by their families, even if family uses the monies. Then begins an annual hiving by unscrupulous doctors to recover maintenance costs till the woman dies;
c. In some cases, surrogates have taken monies and dropped babies;
d. In some cases, surrogates have been paid with little money upfront, and the rest of payment has been denied to them;
e. In some cases, especially when there is a male child or a beautiful child, surrogates have refused to part with babies;
f. In some cases, those who commission for a child have refused to take the child because of looks, gender, or other deformity.
On the other hand there are folks who feel
a. I can't love a child that is not mine...(at least you are honest)
b. Gays and lesbians who want children
c. Some of the surrogates feel it is a good way to earn monies but are sure they would not do it, if they had enough monies.
In this context, adoption is being suggested. People have lived without surrogacy till it came to India. People have lived without IVF too.
I would have forced everybody to adopt one child in this country instead of having that second child, but I am smart enough to know love does not flow like that and a child needs love.
All I can say is, surrogacy has more cons than pros, as I can see them.

I think women willing to do this should be protected, paid and respect given, at the same time though it is a contract that would ALSO need oversight to be sure they arent taking people's money. If they decide not to give up the child they should have to return any monies

Married Women with weak wombs can also benefit from surrogacy. They can still have biological children of their own with surrogacy. Also the child is not the surrogate's mother's biological child because it is not her eggs used, It's the mother who wanted her service.

It disturbs the psyche of surrogate as she is not supposed to get attached to the baby she holds in her womb, which is a defiance of natural system. It also steals motherhood of its dignity and awesomeness. But my feelings. :) Law is not saying that surrogacy is wrong. Wrong is saying only close relatives may do so, like sister, mother, sister in law, and so on.

@vandana7 I know a childless couple who uses the mother's grandma as the surrogate.

I was lucky enough to not need a surrogate, but I think it can be very helpful for those who can't have children. But it has caused issues here too.

But aren't these all problems that can be discussed beforehand and put into a contract that all parties involved can sign, and a lawyer can be present to explain the consequences if the contract is not upheld.
Sure in India the acceptance if this concept might take time...

The first two cons themselves make me say no to the option. I would say go ahead, don't pay for surrogacy. Let me see how many would come forward for it. When left with an unwanted baby surrogate mother can have real tough time! And there are women who do not want to lose their figure but want a child with their genes. Of all the reasons for surrogacy..doh. Lawyer or no lawyer, the situation is it benefits only the physicians. Others are all losers..

Exactly. That is so humiliating and disrespectful to motherhood. Manufacturing units...urghhh...Secondly, ok...the lady says she is not attached to the baby...fine. But if the baby happens have some defects ...like nose or other problems which are not visible in sonography, the party that commissioned would not want it. What happens then is baby is neither loved by parents nor surrogate...how unfortunate the baby would be?

Surrogacy has been around quite a while in this country and, though I am sure some of the problems you list have occurred here too, it seems to work pretty well. Surrogates are pretty well though of and protected by law here.

Agreed! Although blessing for some it is being exploited. Right now protecting the exploited is more important.

There are lot pros and cons of every thing just like surrogacy. But I think in different way that Government does not maintain it that's why This type of situation is created.
There should be registered not only women but every people who is related to surrogacy profession and it should be managed.
If govt does not maintain now, then there is no meaning of new law, Everyone and Everything should be registered in govt record related to surrogacy.
