How to find information about existing wills

I am trying to find out how I can get information about a will that was drawn up years ago. My mother-in-law died a few years ago and we do not know where the will was drawn up. Does anyone know if it can be looked up by the town they lived in or do I need the exact lawyers name and address?

I would try the clerk of courts first where she lived. They would be able to steer you in the right direction if it's not them.

@just4him I just wrote an email to the township where she lived and my father-in-law still lives asking them what I can do just to put our new address and telephone number on it. For all I know my husbands cell phone number might be on it as he has never changed that number. I will see if I get a return message from the courthouse. It is worth the try.

I can understand your dilemma. I think the best way is to be in touch with her attorney or someone she was close to during the latter part of her life. Good Luck @rampo17

We have no idea about her attorney. The one person we thought would know was her nephew and we checked with him and he didn't know either. It is hard to find things out when we lived miles away from her.

@Gabugs She did have a will as she and her husband had it done together and they told us the way it was to be divided. She only had my husband and my father-in-law was married before and had 5 kids. The will was divided in two. Her side was only my husband and the other half was divided in 5 for all of those kids. She was married to my step father-in-law when she passed.

@ramapo17 Maybe she did not leave any will behind. It could be a possibility. Did she live alone?

That is a tough one @ramapo17 and I hope you will share the info with us about how to do this when you find out. For me, a phone call to an attorney we know would be the first step. If there was a probate issue, that info will be at the courthouse in the town where she lived. We had someone die in our family who had a will done in another state. The will was of no value b/c she was not a resident where the will had been done many years before. Things can get complicated.

We don't know the name of the lawyer that created the will so we couldn't look them up. My husband is the only child of the mother and his step father has 5 children. The will was written that it was divided in half with my husband getting 1/2 and the other 5 children would split the other half.

@PatZAnthony We are assuming they had the will done where they lived in another state. Since the passing of my mother-in-law we only keep in touch with the step father as we live far away now. My husband wanted to forget the whole thing and I told him no as he was the only child and that would mean that everything his parents worked for would be given to his step brothers and sisters. That wouldn't be right as my mother-in-law sold the house my husband grew up in. His parents worked hard for that and I cannot see him losing it all.

@DianneN That would be a start. We saw my father-in-law a few months ago when we were visiting other family members. I have's spoken to him since but will call him for fathers day. I thought of asking him for the lawyers number so we can give him our new address and phone number but I don't want him to get the idea that I think he is dying.

I am thinking we will have to do that. Even being we moved out of state they could advise us. The funny thing is one of his step brothers is married to an attorney. I am just hoping that she would be legitimate but I don't want to take a chance.

@ramapo17 If you want, I can ask my son and daughter in law. They are both attorneys, although one is corporate and the other labor law. I don't know if they have expertise in wills.

As you know, in New Jersey wills are registered with the court...so you might try the town she lived in. In TN the wills are not registered, so it would be impossible for anyone to check on ours.
