The Continuing Saga of "The Stalker"

When I last spoke to you all about my daughter's ex-boyfriend and his stalking her, I told you that the police had told him if they found him here again, they'd arrest him. He apparently believed them, because he stayed away for quite a while. In the meantime, he is constantly calling her, both at home and on her office number, texting and calling her incessantly using blocked numbers, and implying he'd be posting some dirt on her shortly. Then came Saturday night. At around 2AM, our doorbell rang setting off the dog to barking and becoming frantic about it. The BF had been texting her non-stop for over an hour up until that point. The bell only rang once, but the next day, when we went out in the car, we found that he had let the air out of all four tires and had messed up both side view mirrors. Effing psycho!!! Fortunately, there was enough air to go to get them filled, but they were all down to 22-26 lbs pressure from the original 34. She asked about getting a restraining order, but was told that unless they lived together or had a child together, they wouldn't do it. That she could only call while he was in the process of bothering her. That is absolutely ridiculous!! UPDATE: Just looked up the statute online and found that the cops are full of crap. If you're over 18 and have had a dating or cohabiting relationship with someone who does any of a large list of things that include criminal trespass, harassment and stalking, even if not pregnant, you can file for a restraining order. Sounds to me like the cops didn't want to be bothered.

@jerzgirl That is horrible and I believe you. The police can be very useless. Do you know someone that can follow him and keep him away from her or can put a stop to his calling and texting?

We were able to put a stop to his showing up. He began harassing us by ringing the bell nonstop for all over an hour. He was repeatedly texting her, making accusations of her fidelity (ridiculous since they were no longer a couple) and then he began throwing stones at her windows. We had warned him we would call the police, but he didn't believe us until the police pulled up in two cars behind and next to his car. He tried to claim he was only here to pick up his things, but Deb brought them out so quickly, the police knew that was bogus. They told him that if they saw him in the area again, he would be arrested. Now he still bothers her, changing phone numbers when she blocks him. It has been over a year and he still stalks her online and by phone. But it's easier to deal with because we know he won't be outside.

That is just ridiculous that she can't get a restraining order against him. He is stalking and harrassing her. Such an idiot. Hopefully he finds a new woman and moves one and leaves her alone.

@Happy2BeMe The law can, as long as he doesn't ignore it. The police were wrong. She can get an RO without living with him, although he was living here until they broke up, so that still should count. And, he doesn't have to be currently doing anything. All his texts and phone calls are sufficient evidence of harassment.

His old GF friended her on FB and says he was the same way with her. His mother's angry because she's airing the "dirty laundry" on FB, but how else do you get action when the law won't help you? Sounds to me like she's been an enabler more than anything.

@jerzgirl Yes it sure sounds that way. She needs to get it out there no matter what it takes. Sad when the law can't or won't protect her.

For sure. He has hurt her physically before (the things you learn AFTER the fact, you know) when I thought most of the physical aspect was because he had little respect for her and didn't take her pain seriously when he thought he was playing, but apparently, there were incidents that were purposeful He's truly a piece of work a-hole!

I might use stronger words, but yes, I know. I'm going to do more research to see if it might just be our local "we don't help renters" city or if it's something more evidence will help happen.

@nanette64 I was hoping her brother could fly in, but he had an emergency with one of his kids the day I contacted him, and he goes back to work for two weeks tonight, so he can't come now.

Just found out that a no contact order can only be issued when a criminal complaint has been filed while a restraining order doesn't need a criminal complaint on file, so we're still looking at the restraining order.
