Great judges - received award of Rs.185000 in the smaller case

Thank you all first and foremost for being supportive. I know what hell it has been since the last couple of years. The amount is definitely not much, but it was not the amount I was after. It was getting written commitment from the Bank, which came in form of counter actually. However, they stuffed it with a whole bunch of lies. I looked like a liar out to get them. Luckily, judges read my written arguments, yes, my first advocate was not up to mark, both petition as well as written arguments and affidavits were drafted by me. I was terrified. The new advocate was good, but he truly did not have much chance to study the case and help. We were in final stages. I was to argue, and made a mess of it, and he covered up as best as he could. But kudos to judges, who realized who was lying in this case. And they not only awarded an amount I had eventually agreed to at the time of compromise (Rs.150000) but in addition Rs.25000 towards expenses, and Rs.10000 towards lawyers fees. I had asked for Rs.150000 all inclusive. Were they mad at the bank for not having accepted the compromise? I don't know. All I can say is, I am filled with overwhelming feeling of gratefulness. I had carried two boxes of sweets, which they refused to accept. So all you Indians, if you thought all people in high places are corrupt, here is a proof that they are not. District Consumer court, Telangana Forum III. You are going to get fair treatment out here. Judges are simply GREAT.

@NormanDarlo Sigh...I know how to read that, it does not mean that is my language. And I think you need to translate...let me do it for you...that is "Meeru Telugu mataladatharu", meaning you talk in Telugu. Yes, that is the language of this state. But keep you guessing..if I say something further you might find the answer. LOL

It is. Though the amount is not much, the issue here was not having any written evidence that could later be used as corroborative evidence to convince prospective buyer or lender. The banker had not given me a single written document or email for almost an year which would become something to convince the prospective buyer with. The position was really helpless. I asked them to publish notice in the newspaper, they decided which edition it will be published in. So if property is located in Bangalore, if I publish notice in Hyderabad, will it be noticed? That too in newspapers that have little circulation. They told me, you can't tell us in which newspaper we should be publishing. The only thing they were offering was letter of comfort on their letterheads, which they can say was not signed by their officials, or misplace it, etc. The judge has taken it all very seriously because the Judge realized I may have to travel up and down to the bank or other banks for selling or for loans for no fault of mine. I think they gave more because the banker refused a reasonable compensation I sought at the time of compromise and I could prove two of the 8 lies that they had mentioned in their counter.

@arunima25 Yeah...more than two years...but a new precedent has been set. If it is not contested this holds good for subsequent cases.

So you finally god 185,000 Rupees from the Bank? It's about 2,475 $ if I am not wrong. It is ridiculous that a Bank goes to court for this amount.

In India that is a decent sum. My 3 months expenses including medical bills insurances clothing, gifts and guests, and minor building repairs. But as I said, it is not what I was looking at. They were not leaving any evidence with me that would enable me to sell the property or build on it, or avail loans on it. Effectively, I could use it, but I could do nothing beyond it. That is why the entire exercise.

@LadyDuck Exactly. Before approaching the court, I had given them an offer that they would not have spent anything. LOL. Not one cent. LOL. But their lawyer guided them otherwise.

@vandana7 I am not saying that it is a low sum, I am saying that it is a shame that a Bank go through Justice and does not decide to fix this matter with you without spending money for a lawyer.

I don't know the whole story, but Kudos to you and your lawyer. Getting legal work done is an achievement in itself more so in corrupt places. Yeah, not all are corrupt. Thankfully justice still prevails.
