Okay so maybe you can help me ease my fears. On November 5th I have a disability appeal with my lawyer. The State of Florida is trying to tell me I’m no longer disabled and before I moved here MS was trying to tell me the same thing but I had my case in appeal when I moved to Fl so it followed me here.
An alj went against me but I appealed it again and the Disability board kicked it back to an alj but they sided with me. This next case is my last appeal and if it goes against me then I’m going to have to find a season job that will hopefully lead to full time employment.
I’ll have to hunt down the hiring managers at stores to explain my situation. I was going to get the same alj after my disability notice told me I would have a different one. He moved out of state and now I’ll have a new one. I’ll definitely have a new one now and hopefully he won’t be as hard headed and unwillingly to listen.
Have any of you gone through this same process?

Get denied 3 times, then get an attorney and usually toy will get it. I know many disabled people who do get the SSD or have to go back to work.
May I ask what your disability is?

First and foremost what is your disability? I'm on disability and have been for many years. It was backed up by exams by many many doctors on both sides, my attorney's side and the state disability's side. It was proven that if I were to go back to work again I would end up totally physically in a wheelchair and unable to function. If that was to happen I would own the company that caused the original injury. I was also told that the pain levels would increase as would the lack of ability to use my arms and legs. It's been happening and the doctors I have now are going nuts trying to make life comfortable for me. The C5,6,& 7 discs are bad in my neck from the injury and they can't do surgery on them because it would cause me to be a quadriplegic. It was proven that I was no longer physically capable to work and if I were to do so it would cause further physical damage that would cause me to be wheel chair bound. As someone once told me when I started on the journey to get disability, you have to be beyond repair to get disability.
I don't know what an ALJ is, but if you can't get satisfaction from this one, I would request a new one and if they won't give you a new one I would threaten a law suit. You still have rights and you have the right to have someone who will listen to you, understand, and help you as much as they possibly can. If it is proven that you are able to work you should be assisted in finding a job where you are happy and productive and understood and helped in every way possible. I have seen a lot of disabled people in jobs where they are treated with respect and love like family members and they go to work with a smile on their faces and happiness in their hearts. When you ask them they tell you that they honestly love their jobs. Obviously an ALJ is there to HELP YOU, and if they won't listen and understand they aren't helping you! You need one who will.

I agree with you a hundred percent. An ALJ is an administrative law judge. They are suppose to understand your situation and listen to determine whether you can go back to work or if that’s just not possible. My lawyer got me this date after the old stubborn judge denied me. The old judge was going to do everything in his power to prevent me from reapplying for disability but now since he has nothing to do with the case he can’t prevent me from reapplying if I have too.
Social Security diagnosed me as having “severe depression” and I don’t know the factors that led up to that. It seemed like the old judge was having a bad day and he would not listen to me and he just wanted to get out of there. Even went as far to challenge the fact I had nothing on record from my family when they were the ones who kept telling them what happened because I have no memory of it. So I challenged the authority of that judge and won. That old judge was going to over see my case again but he moved so now I have a new judge and will have to travel to Clearwater.
Now I have seizures. We think they’re Pal Mal. I’ve always called them zone outs and I’m on medication for those. SSI was my only form of income and I was specifically told that I cannot work when I was in Mississippi. What messed me up was the ticket to work. Don’t ever get on that. I haven’t been having any since I’ve been on the medication. The State of Florida is trying to tell me that my condition has improved and it seems like nobody is listening or paying attention. I’ve been telling them the same thing since I got disability. That there’s been no change so I wonder how they can get a report of no change to has improved.
Luckily my wife was able to get me on her insurance but I won’t know anything until after November 5th and there’s a chance I could get back up to 2 years back pay even though it’s been three. Social Security is trying to get me to pay 25 grand that I don’t have as well. That will go away if I win and if I lose I will have to work and they’ll take my taxes. But this process has been stressful and on Nov 6th I’ll update you guys and gals. I appreciate you taking the time out to listen and also appreciate you responding as well

@TampaxMemphis I have started having seizures. They are stress seizures and they come on unexpectedly. I'm on medication for them and was in the hospital for two days at the end of July for them. Part of the problem from the seizures that I had in July is that they did more damage to my neck.
We visited the state of Florida twice and noticed that they march to the beat of their own drummer. They are very different to say the least. They are saying that your condition has improved so they don't have to put out the money that they don't have to pay out. See if your attorney can get your records from your doctors in Mississippi. They should help a LOT. Also another pain in the rear is moving from one state to another. I live in California and as much as I would like to move to a cheaper state to live in, I don't dare for the effects it would have on my disability.
With the kind of seizures you have I would believe that you really wouldn't be able to be hired at most kinds of jobs. First of all they would need to be able to get insurance on you and that would be next to impossible, even if you're on medication that controls the seizures most of the time. Also you can't really handle a job where you are handling heavy equipment, heavy lifting, driving vehicles and so much more. Most employers want you to be able to handle a plethora of jobs... I would suggest that if you don't win on the 5th of November that you go to a higher authority, the state senate with your problem. Don't stop fighting, you have a valid case.

I had to sit with a committee and brought a note from my doctor telling them because of my shoulders I cannot do certain things.
