I mentioned on my previous post about land matters and I finally filed a complaint (reconveyance of titles tainted with fiendish bad faith and Smart-Alecky fraud) in our Municipal Trial Court for and on behalf of my elderly parents (with Special Power of Attorney). My first time. My lawyer always reminds me to take care always. Huh! I hope this ends well for me. Have you sued someone or been sued?

Take care. I think land dispute is a long legal battle and this is one of the most common cause of dispute/misunderstanding/battle and broken relationship even within the family circle. Good luck.

True! And the saddest part is when majority of family members are not supportive. It's like - fighting ALONE and when you win the battle everyone wants to "reap the fruit".

But if they removed you as SPA then why do you still need a lawyer? Are you not removed from the negotiations because you are not SPA anymore?

@owstalaga almost everyone thought it is. It could happen if parents sue me and if they do.. it would only prove their insanity.

Only the authority to SELL was cancelled/revoked. I learned that -- an SPA is still valid if there is no Court Order for Cancelation and the Court will not cancel if there is no complaint or if there are still pending case. So maybe I better sue all gossipers too and all those who send wrong signals to my parents and sisters.

'... reconveyance of titles tainted with fiendish bad faith and Smart-Alecky fraud...', please explain in simple terms. Have you sued someone or been sued? No on both and I intend to keep it at that.

Simple terms: CANCEL LAND TITLES AND RETURN THE PROPERTY TO US DUE TO FAKE SIGNATURES OF OWNERS (my parents') ON DEED OF SALES WITHOUT CONSENT. I sued them.

@AkoPinay I know that those matters take time, but I am sure you will win. I had to sue people in the past, but we won.

I wish you luck and success. Land disputes sound really scary in The Philippines. Isn't the mother and son that was shot was due to land disputes as well?

It's a civil case and if it's a land dispute, I'm sorry to inform you that it's going to take ages.

Yes the previous civil case of this lot was 1989-2010. The decision of Supreme Court is in favor of my parents. That time the defendants were my parents. This time we are the plaintiffs. This lot always attract fraudsters. Huhuh

@AkoPinay You and your family are in my prayers. We are also fighting a "battle" for a piece of land that has been occupied by a person. In our country the legal system is too slow.

So far we have been fortunate to not face such legal trials but I know of near and dear ones who have gone through that. Not sure about your country but here the legal fights take too much of time and are actually a big toll on health and finance. Wishing you luck. I hope all ends well for you.

I can understand why your lawyer keeps reminding you to take care always because land disputes can be very "messy" at times. I have not experienced being sued in court yet but I have filed a complaint to our town's barangay captain against the owner of a lot next to ours for abusing our boundaries. Our caretaker would report to me that someone armed with "sharp objects" keep patrolling our street at night. Oh scary
