Well, I don't know when I last posted about my son's case, and I don't feel like looking, but this is one situation where delays caused by Covid and other things have been our friend. He had a district attorney appointed who had a Brady violation in his prior job, and we got lucky. This guy went back to his old county and the Board of Supervisors there appointed him to replace the elected DA, who resigned. Good riddance and my condolences to Nevada County.
The DA who is taking his place used to prosecute youth crimes in juvenile court and our attorney says she is an actual human being who understands that children are not adults and that people with cognitive disabilities don't necessarily react the same way as people who don't have them.
The DA who left did not turn any of the defense discovery over to her, so our attorney had to copy it all over again and send it over. She was apparently quite surprised to find out that the case wasn't quite how her predecessor had represented it, and she sent out an investigator to get statements.
Well. Her investigator got hold of the very young woman who was hiding out in Arizona and wouldn't talk to us. First her mother told him that her daughter had lied, and then told him her daughter was right there. The daughter confirmed that she had lied for the young woman who is accusing my son, and that the accuser had asked her to lie or she wouldn't be friends with her any more. The DA's investigator got that on tape.
Also, our investigator got more people who stated that the accuser is a liar and about some bigger things than what we knew about before. We do have a hostile judge though, and we don't know how much of this type of evidence she will allow in.
Best case scenario, the DA decides she doesn't have a case and drops charges. Other possibilities, she decides to take it to trial even though she doesn't have a good case (wouldn't want to be accused of not being concerned about victim's rights). Or she could make an offer that doesn't involve a felony or registering.
Sucks that someone who is innocent might have to take a deal, but might be better than going to trial as you never know what a jury might do.
At work, my team filled out the employee survey and trashed my evil, micromanaging boss, and she is gone. Ding dong, the witch is dead. The elderly parents aren't getting younger but at the moment they are doing OK.

That's one hassle I hope I don't have to experience. Covid 19 pandemic days are bad enough already.

Ah, been wondering how that was going. I am so glad that young woman was found and that she finally fessed up about that - that is HUGE. Please oh please I hope this gets your innocent son out of this. Keeping fingers crossed for that best case scenario!!!!
I could never get rid of my bosses like that . . . all my bosses were the company owners .
