Be the judge ..

Suppose I am a corrupt official. I accumulate a lot of wealth through wrongful means...under the table earnings. I push it on my wife, my kids, my parents, and even on my siblings names. Some of it is on my name too. I cannot risk my wife divorcing me, my siblings and kids running away with my monies. LOL So now somebody catches me. All my ill deeds are out there in open. Should my folks get clear title to what I have earned wrongfully? Be the judge... My thinking...NO. I would punish the family more because many a time they know the truth ... but try to push it under the carpet because of social and financial benefits. At least in India.

Somehow, I always feel Americans are more honest than us Indians. More rule abiding. If you ever traveled on Indian roads you would know the basic Indian nature.

I cannot judge him as such but at the same time if I had a chance to get the money that was owed to me by the Family I would not accept it as it is not good money it comes from a lot of jealousy and spite from their part. Its not good money that he has made and they would not benefit from getting his money either.

@vandana7 Yes, that is right. What was meted out to me as they left me out of the inheritance on purpose and a lot of nasty stuff went on there from their part you know being sly, spiteful as much as they could for me its what we call here "blood money". It does not come from a good place it will hold bad energy and I was having none of that so I politely told them to keep or do whatever they wanted. That kind of money will only bring problems of all kinds to whomsoever takes it on.

Interesting take. Somewhere spirituality has to takeover. Nevertheless, it will set a bad precedent and others who are not yet in this frame of mind, is likely to be agitated which will cause bad vibes and jealousy and anger ..whatever. Either way the result is gonna be the same, right?

Here, the accomplices would be prosecuted if the DA thought she could prove they knew about the crimes. That seems like a good system.

Whether they know or not it is still not what belongs to them, right? While there will be money that cannot be recovered like monies spent on parties, clothes, shoes, travel, monies that can be recovered from jewellery homes and cars should be recovered I feel.

@xander6464 That is where people in my country can be forced to be honest. Like Income tax returns they would need to file property holding returns. If the change in assets holding shows spike, following the parent's entry into picture, then the property bought with it, can definitely be confiscated.

Everybody involved in the scheme would be liable and accountable. In the U.S. we call these people "accessories." It is also something classified as "money laundering." Highly illegal.

Accessories is somebody who would voluntarily join the act. There is no role per se of these people. They are family ..for all practical purposes, they are not aware of the crimes the head of the family is doing. How can law punish them then? Under which clause.

@porwest But even if they did not know that their parent obtained it by wrong means, once they know that it did not rightfully belong to the parent to gift it to them, shouldn't they return or shouldn't they be made to return?

@vandana7 It would all depend on investigation and evidence presented of course. If it could be determined that someone knew something or was complicit they could be held legally responsible.

But if I have taken 10000000 USD, and transferred 7000000 on my wife and kids...surely punishing me and recovering 3000000 USD from me is making me have the last laugh.

No matter which local Judge here would "trace the origin of the money" and block also the accounts of the wife, siblings and no matter who are hiding the stolen money, including friends.

That does not happen in India. :( This makes it easy for wife and children to hire gangsters to shut the mouth of victim trouble the victim.

@vandana7 This happens here, they check the Bank accounts all those related to the gangster or corrupted politicians, or no matter which criminal.
