Ok... the scenario is every other day we hear about rapes and gang rapes. The issue has become as common as the detergent advertisement.
So yesterday a minor was gang raped, and there were minors among the rapists.
International bodies like Amnesty need to understand that a juvenile in the west comes up in a different scenario when compared to a juvenile in my country. The law and order takes quite some time to really punish, and punishments are laughable.
Given such a scenario, don't you think a boy even if he is just 11 or 12, if he is capable of raping, then he needs to be tried for rape, notwithstanding his age.
And that parents need to be punished too with some financial fine for not having brought up the kid well.
At the risk of sounding communist .. I feel each one of us has duty towards the country and society. Which takes precedence depends upon the situation. But these duties are sacrosanct and above the duties towards family. Failure to do those duties is to be treated as anti national act. So we should respect the rights granted by constitution to fellow citizen, minor or not. If those rights are infringed due to some act of mine, I should expect punishment equivalent to that I give to a terrorist. The punishment needs to be defined upfront so as to work as a deterrent.
Why is a rapist equal to a terrorist? He disrespected the clauses in the constitution through which the victim derived her rights to live safely in this country.
The rapist should be penalized monetarily, and if he cannot afford to pay that much his next generations or siblings would pay. This amount should keep on increasing at inflation rate. Limitation act should not apply to such puinshment.

I tend to agree with you. A minor raping another minor is missing something in his upbringing and may have some mental challenges mixed in. A "child" starting out his life this way shows that there are some serious problems.

I agree too. A minor who can rape has serious girl-hate issues. Scary.

@xander6464 Oops..sewing machine ...sigh. The arguments presented by the legislators was....he is a kid, he can be goaded to do things...by adults around or what the victim was uttering. Just because he is a minor. So not his fault. He needs to be given a chance to restart his life. So sewing machine to work as a tailor.
The guy used a long iron rod and shoved it inside the uterus of the victim. Pulled part of uterus out...the girl survived all that... to tell the horrific stuff. But legislators did not do much. Instead, the girl's brother was given a government job to quieten things up.
Where was Amnesty International when such injustice happened? They only stand up for small children being punished...but this guy was 17 years few months old! Almost an adult..how did he qualify as a minor and a kid?

@vandana7 That is sad but pretty typical. The world always seems to have more sympathy for the rapist than the victim.

Family should be involved. Somewhere we go wrong in thinking it is only about love. It is also about the country having provided resources amenities etc., to ensure the survival of the country for the next generation. We can't just use the resources, and forget about corresponding obligation.

I agree with you. It's a shame that such incidents keep rising in the civilized society.
And rapists are as bad as terrorist or even worse

@vandana7 They did. While the culprits in Nirbhaya case were pinished, it was a long wait. Justice delayed is justice denied.
And the one juvenile escaped the wrath of punishment because he was shy of few months to be trialed as an adult

I think your stand on it is pretty reasonable. It's not as if like asking their balls to be chopped off for raping.

One of the 6 accused of nirbhaya case was also minor.
He was sent to reformation home for 3 yrs and then relased.
It was such a heinous rape and murder ,how can he do that with a mentality of a child?
It obvious that the mental state of such kids is not like child and they should be given proper punishment considering the severity of crime.
Once released they might commit more crimes

You bet. More crimes, better execution ..will not repeat same mistakes. Has taken training in the reformatory home...has developed contacts too...so that he will get help and give help to bad people. Wow...just wow...and legislators did nothing to bring down the cases. I feel the same way about acid attacks.
