THE WORLD REALLY HAS TWO DIFFERENT MEANINGS OF THE WORD "FRUIT".ONE WHEN YOU GO TO THE GROCERY STORE N ONE USED BY THE BOTANISTS. BUT TO REALLY FIGURE OUT THE TRUTH WE NEED TO KNOW WHAT MAKES A FRUIT A FRUIT AND A VEGETABLE A VEGETABLE? THE BIG QUESTION IS DOES TOMATO HAVE SEEDS? IF THE ANSWER IS YES THEN TECHNICALLY ITS A FRUIT. This, of course, makes tomato a fruit. It also makes cucumbers, squash, green beans and walnuts all fruits as well. VEGETABLES such as, radishes, celery, carrots, and lettuce do NOT have seeds (that are part of what we eat) and so they are grouped as vegetables. Now THIS DOES'NT MEAN WE go looking for tomatoes next to the oranges in our GROCERY stores. Certain fruits like tomatoes and green beans will probably always be mostly referred to as "vegetables" in today's society. So a tomato is the fruit of the tomato plant, but can be used as a vegetable in cooking. Here's an easy side dish with zesty flavors that features fresh tomatoes. SMOKEY TOMATO SALAD 4 medium tomatoes, diced 3 cloves garlic, finely minced 1 4-oz. (396 g) can diced green chiles 1/4 t. + 1/8 t. Wright's Hickory Smoke Seasoning (liquid smoke flavoring) Salt to taste Freshly ground black pepper to taste Chopped fresh herbs for garnish (oregano, marjoram, parsley) Combine all ingredients in a medium-sized bowl and season to taste. Garnish top with fresh herbs, and serve as a side dish. Serves 6. IN INDIA WE HAVE A SAYING AAM KE AAM GHUTLIYON KE DAAM (THAT U EAT THE FRUIT OR SAY VEGETABLE(IN THIS CASE) WHY WORRY ABOUT THE WAY IT WAS MADE) I.E JUST ENJOI MAN!!!!

According to the United States Supreme Court (Hedden V. Nix, 1893) the tomato is a vegetable. So, I go by their ruling.

A fruit is an ovary. It is a food or plant that contains seeds within it's body. It is like an ovary in the sense that ovaries have eggs within. A tomatoe has seeds within it's body. Therefore it is a fruit.

"Fruit" is technically produced by the female plant and is what allows the perpetuation of the species; it contains the seeds. "Vegetables" are part of the plant-they are vegetation, such as roots or leaves, and by themselves, cannot reproduce. PS: I'm going to try your salad!
