can i KILL my neighbors snake if it's in my yard?

this is the second time my neighbors exotic python has gotten into my yard. i have a 3 year old nephew and other kids that play in my yard. not to mention snakes would not be my preference for a pet. hate them. the 1st time my neighbor said, "SORRY, my mistake." this time, "OOPPS I won't let it happen again." now it's time for action. can i LEAGALLY kill it, when it comes in my yard again? does anyone know?

I don't know if it is legal or not. But I wouldn't blame you, I would probably do away with it also. If I were you though I would check with animal control in your area. You don't want to end up in court about it with animal rights' people. If animal control had to come and get it your neighbor would probably get ticketed and fined and the snake could be confiscated.

everytime it has gotten out , my neighbor has been home. i have tried to be a good neighbor. so i would let him know to come get it. we do have to live next to each other. thanks , you're right i don't want to end up in court.

I killed a rather large python once and a Heavy object worked rather well. cover your tracks though

First of all...why in the world are your neighbors letting their snake loose for? Im gonna have to agree with some of the others. YOu should call animal control. You have young children around, what if that thing were to attack that baby!!! Then would your neighbor just be like "oh sorry, my bad"!! Explain that you are worried that it will get in your yard again. Most likely they will give your neighbor a warning about keeping it locked up. If it happens again...they will probably be fined and the snake would most likely be taken away. Thats how it works around here anyway. (sorry animal control in the family. LOL) Good luck with everything. Snakes are nasty creatures!!!

well my original question was, "is someone responsible enough to have an exotic pet, like a python snake, in their house? If it gets out once?" Are people who have never had these kinds of pets before responsible enough to have tigers, monkeys and pythons snakes, scorpions as pets? yeah, they get out, things can happen, but isn't that what the trained professionals are supposed to know how to handle? Before it happens? so should anyone be able to have a pet like this?

Check with your local police department and find out what your legal rights are. Ask them for advice! Be sure to let them know you are not filing a complaint, just asking questions to educate yourself about your legal rights. I would talk to my neighbor, as pleasantly as possible, and let him know what the next step will be. If you have to call the police or kill the snake after that he will not be able to say he was not warned.

thank you, animal control is definately an option. someone earlier mentioned the police. i'll try talking to both. having someone else dispose of the snake sounds like a better idea.

I'm not sure about that and you should probably check into your local laws because laws do vary from state to state. I know you want to take care of this because of your children but you also have to live next to your neighbor. If I were you and that thing popped up in my yard again I would call animal control and let them deal with it. That way they know you are serious and might be able to get the snake again. Even if they can't get the snake back I think that having a third party getting involved might be better than just killing the pet and having to deal with your neighbor one on one.

not sure, but, if you do kill it because the snake was about to attack you, "self defense" i don't think you should be charge with anything, since like i said, self defense that's a whole differente case. hope it helps,a nd i aslo hope it won't happen again

we have to live next to each other. i don't want to be in a situation, where i hate comming home because of my neighbor. maybe he would understand if i had to destroy his pet because it was attacking me. and we could still live together friendly like?

Yes. If he is in your yard and you fear for your life, who will blame you. Ask questions later. Tell your neighbor, "Sorry, it won't happen again." Save that baby.

I wouldn't kill it. Pets are like family for many people. I wouldn't want someone to kill my family dog, whether there was a good reason or not. However, you have every right to take action. Like many people have said, the first thing you should do is to get some legal advise. Then, I would talk to your neighbor again. Your neighbor needs to understand that there are small children in your house and you fear for their safety. And no matter how many times your neighbor tells you that the snake is harmless and won't hurt your kids, do not believe him. Even if the snake won't harm your kids, you don't want to take that chance. There have been many instances throughout the country where a friendly animal suddenly attacks for not reason. Just remember that you can tell your neighbor to keep the snake away from your house in a tactful way that will keep peace. If your neighbor gets defensive, just call animal control. Pissing your neighbor off will be better than your kids getting hurt or killed.

i wish there were a place people could live where certain pets/animals were not allowed. and a place where certain pets/animals were allowed. if people wanted they could choose a place to live based on what animals lived where.

ABSOLUTELY. The childrens safety takes first responsibility. If that snake is a danger to them then you have the legal right to do everything required to protect them which includes killing that snake. A bonus, is he will probably be fined for not having his snake properly secured.

thanks, good to know. i don't know a lot about snakes. I have never had one. But, from what i understand, if something is small like a dog or 2 - 4 year old kid, they want to eat it. this is what I have heard about large snakes. to me if this snake is in MY yard. And there are kids in My house, to me thats a danger. very dangerous, because you never know when and if it's going to pop up. i see i have many avenues now. thanks for your info

this is attrocious. You should lodge a complaint that they are being a nuisance - the neighbor and the snake! and the very next time when it again crosses into your boundary, you can kill it i suppose as a self-defence.

Please don't kill it. Try calling Animal Control. They will come out and remove it, and hopefully place it in a better home. The snake is probably harmless. He doesn't deserve to die because he has an idiot for an owner.

as my dad was a lawer.i asked him about this.so he said if we kill the snake they may question us that why u killed my pet snake without creating any harm to u for which they may claim damages etc.but we can give a complaint to appropiate authority 4 taking necesssary action against them.

Can you build a fence covered with wire web around your yard. Just to make sure the snake wont enter your yard. choose the small holed, so the snake wont slip between them. Your neighbor wont be offended, and the children can still play freely

id rather kill the snakes than getting bittten..pythons are poisonous..and i think you got a right to kill it coz its within ur territory..of course im just basing my comments in my place..
