A surprise I didn't need!

Maybe some of you will remember that last year, I was in a car accident. A lady pulled out of a fast-food restaurant and slammed into the side of my car, while I was driving down the highway. Police were called, she received 3 tickets, and although I had to wait a LONG time for the proper parts to arrive, it was fixed and her insurance paid for it. She only had liability, and her van was 27years old. It was considered totaled out. So basically, she got left high and dry without a vehicle.
I received a notice from her insurance company that they were investigating the accident again! I had all the papers, accident report from the police, etc. It seems that they want me to pay for the damage to my own car, and she hit ME. I don't understand. They already paid the bill to the body shop for the damage to the car, this past summer. It was a done deal.
How can her insurance suddenly decide to go after me for something like this? I have heard of others going through horror stories, but this was signed off, fixed, etc months ago The lady had to go to court and pay her tickets. Police were there for the accident. My son was in the car and he is a witness if he has to be.
Now they say it's my fault? They want me to pay for the damages for her van, and I was told it was totaled out. She got the tickets. She hit ME. They already paid!!
I have to ask, WHY?? How can this even be a thing? They paid, and now they want to back out of it and blame me???
I will fight this to the bitter end. I am not paying for the accident when she got the tickets.
This is insane.

@MarieCoyle If the issue was resolved, I'd question the ligitimsy of the letter at the very least. Not take it on face value it's ligit. Some scammers will get info that's public record and try to get money that way.

I wouldn't fight it but SHE got the tickets, her insurance had no problem working with me and paying the bill. That was months ago. And now this??? Crazy.

I would think this was a closed case . . . everything was completed and paid for already - and it seems to have already been proven that it was her fault. How can they open the case again? Definitely talk to your insurance company. I thought the insurance companies had people dealing with this stuff on our behalf - so I don't know why the other side contacted you directly. I'd fight it too - they cannot pin this on you!!

@MarieCoyle Make sure too that it's not some kind of scam. I feel insurance companies are now trying to get out of paying for things .

They definitely are not wanting to pay for a lot of people having lost everything in the recent hurricanes. People who had insurance are now left with nothing at all. This is just so wrong.

It makes me so mad. It was a done deal, I did nothing wrong, just picked up the accident report from the local police, and it says exactly how I described the wreck. Why is this even a thing?
I fear in this day and age, with all the insurance claims from all the horrific weather events, that insurance companies will be doing more and more of this to avoid payment at all costs.

Oh, we will fight this! I’m not paying her to hit my car. This is just nuts! No, a lawyer wasn’t required as it was cut and dried. Her insurance company contacted me and were very cooperative about fixing my car and providing me with a rental car. And then this??

That is totally ridiculous.YOu have all the evidence paperwork etc. I wouldn't cooperate in the least. I don't they can touch you legally, and if they harass you I would get a free consult from a lawyer. Shame on them!

@MarieCoyle I would just be unavailable whenever they try to contact you. They aren't going to sue you, I think they know they don't have a leg to stand on. You seem to have bad luck with a lot of this kind of thing.

My oldest son and I are going to be hard to deal with on this. She got the tickets, it was her fault, and now they say it could be MY fault? They paid the bill. I think she is grasping at straws because her car was totaled out due to age and damage.

I can honestly say that I will give it all I've got and so will my oldest son, who will be helping me. My other son was in the car during the wreck and saw everything, so if I need a personal witness, I have one!

That sounds incredibly frustrating! It’s shocking that her insurance is backtracking despite previous decisions. Stay strong, gather evidence, and consult a legal expert if necessary. You deserve justice in this situation!

As of this morning, my insurance has turned it over to an investigator, who thinks they do not have any leg to stand on--the lady got the tickets, the accident was declared her fault, and furthermore, HER insurance company paid the entire bill months ago! The investigator I spoke to is just flabbergasted. I have an excellent driving record. In 1999, I was rear-ended by a teenager who had had his license for exactly ONE day. He got the ticket. That's the extent of my accident history in the last many years...I am supposed to hear from the investigator tomorrow, so I hope that she has good news for me. I just don't need any more stress right now. Thank you so much.

I doubt the legitmacy of that letter. There are scammers and pranksters out there. Again , why would an insurance company after an year of settling ask for the money. I have a funny feeling it is a scam! I would rather call the insurance company and check with them directly on same. If they confirm they have send you this , hire a lawyer and sue them for harassment and get a good settlement! They have to prove you cheated , which is never the case. Plus there should video footage from that area . That should be good enough to prove your innocence plus the police records. On a lighter note , you should make use of the opporturnity to earn big bucks! Jokes apart , do a thorough check and then hire a lawyer if needed! Take care!

The letter is from her insurance company. I will hopefully find out tomorrow (Monday) what can be done about all of this. Thank you.

Do you have liability or full coverage? Even tho it’s her fault, if you have full coverage, your insurance company will manage her insurance company trying to come after you. If you only have liability, then you are at their mercy to do the right thing. But of course you can take it to court which if you have all the documentation especially the police report, then you should be fine in the end.

I have full coverage. She had only liability.
