Full custody

I have a 3y old living with me. Me and the father we never get married and since my son born he never came to visit him. Now I live in NC and he lives in MA. I just got my legally documents to travel and work and the problem is: the father doens't want to give the authorization to my son see my family in Brazil. He pays a little bit money every month, but it's not enforced by court, this is just agreement between us... I don't have money to pay a lawyer yet. What should I do?

O.k By him signing the birth certificate does not give him joint custody, it only recognizes him as the father, lets get that out of the way first.
Please as soon as you can contact your local bar association and explain the situation to them, they can give you the listing for an attorney pro bono(which if you don't know means a free attorney), they will give you proper legal advice.
I think you should also go to your local family court house and file the petition for custody of your child, and in this petition make sure there is a statement to include your holiday travels:)

Any time:) I know how hard it can be, I found most out about custody and court by going through it myself. So that pushed me to persue a degree in paralegal science, and I am glad that what I can tell you as by law NO ONE may give any type of legal advise:) So please take what others tell you to heart and with a grain of salt, personal experience is the best advise anyone can really give.

I don't think you need an autorization. Do you sign any paper saying that he has a join custody? If not, you do not need any paper.

Well, he signed my son's birth certificate, the think I know is automatically when he signed he has rights and join custody too...

Actually the Brazil consul and the USA Visa Office they requested his authorization. And I don't see me in Christmas time or a New Year with my family... I don't know any process can be faster that full custody, apparently...
