In the news here where i live there was a man that was jailed sixteen years ago there is now dna that shows that it is not his, he wrote a letter to the man he knew did it and that person killed himself after reciving the letter and in his sucide note it was assumed that he was the correct person, the DA does not want to excume the body and test the dna on that person, what are your thoughts on that.

I would want them to exhume the body to prove it! Sixteen years is a long time. I would hope they would go beyond the measures to prove to all that the person that did those years did not do it. I would also hope they would do something to help the man re-enter society due to wrongful justice.
Sadly, we are hearing more and more cases like this due to the advancement of science. But at the same time, we are also nailing those that really did do it because of the same advancements. Things also seem to try to balance.

I think they should get the guy out of jail. It doesn't matter what they have to do to do so. They should correct this with no questions asked. He has been there long enough and did nothing to get there.

I would want to know. Get the man out of jail that didn't do it. I would insist that they exhume the body and do a DNA test. Close the case the proper way. Instead I figure the DA is worried about the expense. However, look at the expense that was already wasted keeping the innocent man in jail. Think if the expense the state will have to pay the innocent manif he decides to sue for unlawful inprisonment. Exhuming a body for DNA will be just a drop in the bucket.

It is a sad fact that the position of DA is a political one in the US. Having a conviction reversed for any reason is considered a political liability. Even when doing so is the right thing to do...
If the man who was/is currently imprisoned for this crime is released, it leaves the 'case' open with no closure for anyone involved.
As the DA who tried the original case is probably no longer in office, reopening will add to a case load and take county money and time to investigate, and retry, not to mention the political fall out.
All too often the wrong person is imprisoned for a crime, and in the event they are exonerated, there is no apology offered or renumeration for the time the person lost and the loss of respect and postion in the community.
For the sake of all the families, the exhumation should be done.

Well I am glad the person who was jailed was found inocent of the crime. as for the one who committed sucide, we will never know, and I think it would be upto the family to decide if they want to know for sure

Wow...that poor man just paid 16 years penitenciary for another man's actions...they should compensate him for his time, that's for sure. I know money won't bring back the 16 yrs he lost, but at least, it'll allow him to live good for the next coming years. And they should also publicly clear his name.

You have to love that DNA testing. It works both ways...Catches the bad guys and frees the innocent guys. Hopefully in the future no one will spend sixteen years waiting....Was ths evidence the work of the Innocence Project? They spend a lot of time working pro bono to establish innocence in cases like this.

I would think that he should be released from prison and compensated in some way financially due to the errors that the justice system made. What is the point of even exhuming the body, when the first DNA proved that the incarcerated man was not the murderer? DNA doesn't lie. If the state doesn't want the cost of exhuming the body and solving the case, that's their option I guess, but the innocent man should be freed.

That should be investigated further and the case should be opened. If that man was accused wrongly, he should be compensated. The person who was the murderer killed himself most probably of fear of getting jailed. That is more than enough to judge him guilty and the person wrongly accused of should be justified correctly. The DA should be fired!

they need to exhume the body so that both families have closure but that will not give this man his life back. Even though he has been aquitted of the crime it will forever haunt him and he lost 16 years of his life that no one can give back. He will forever be known as a criminal even though he was not guilty the stigma will follow him.

even if he will be released, noone can ever pay back 16 years of his life completly wasted. that's a real sad story. in my country there was a similar case also. the guy was married and had a daughter. after 8 or 10 years (can't remember well) spend in prison, it turned out he was inocent and didn't raped anyone. yet after all those things, when he got out ... he didn't had a familly anymore. that is sad and noone can make up for his loss ... years and familly.
