who is right and who is wrong

Recently i have come across an incident on which still iam not sure who is correct and who is wrong. i want to see the responses of different people here. i was waiting for one of my friend in place, in the mean while one guy was cross road wiith thinking some thing else in mind. suddenly one car hit him and he was fully damaged. it was a high-way so people in cars moves very fast. what i felt was what ever car driver did was right. if he had slowed down a little bit the damage must have been higher than what was happened. Ultimately the driver was punished. guys tell me who is wright and who is wrong

I understand what you are saying, if the driver had slowed down the other cars behind could of collided with him as well. So this man is crossing the road absent minded and is hit by a car. I don't believe the driver should have been punished. It was an accident. If he was speeding then he should have been punished but if he was within the limits then no he should not have been in trouble. I feel bad for the man that was hit but maybe if he was paying more attention to the traffic the accident could have been avoided.
