copyrighted image issue

does anyone know how to find out that an image is copyrighted or not ? if i found an image given by my friends through email, how do i know that it is copyrighted or not ? do you have any suggestions about sites to get free non-copyrighted image ? it's just bother me, because i really don't know about that things ... thanks, and i really appreciate all of your comments here

Photos are automatically copyrighted by the photographer. That applies if they are taking hobby shots, shots for pay or any other reason. Every photo is copyrighted. Some photos have been granted a release to be used for specific purposes, or may be released for general use, but you would see a statement about that release.

what if i can't find any statement about a photo release ? ... honestly i still confused with the kind of picture that can be distributed freely, especially here in mylot. But according to both of you that put comments here, then i'll just assume that every picture have been copyrighted by it's creator, so i'll put only pictures that only captured by me. Thanks jayperiod.

That's the best approach. Every picture has a copyright, even if it doesn't state it. For example, my photos generally carry a digital signature of the copyright. It's in the meta data of the image. It takes a photo editor to generally see it, but it's legal.
According to the terms of this site, they state that the only photos you are to put up are ones you took. That way they can be sure of the copyright issue. Technically, myLot can be held accountable for allowing images that the poster doesn't own the copyright to. Someone can sue them and they will win.

A few things:
1. Do not assume an image is anything but copyright. It's unlikely that anything ever published doesn't have a copyright pedigree.
2.Current international law is that anything in "tangible form", like an image, or something visible, is in tangible form.
3. US Copyright office has some links on copyright basics, well worth a look.
4. Use of copyright material relates largely to whether you intend to make commercial use of the material. Private use means reasonable personal use, excluding copying or reselling. Your friends, by sending you an email, probably haven't breached the copyright. Some nitpickers might make a court case out of exceptions, but in terms of reasonable use, what are they supposed to do with it, lock it in a safe?
5. Be careful of "copyright-free" claims. Sorry, but somebody, at some point, DID own the copyright.

thanks wanderlaugh, so from now on i'll assume that every published image is copyrighted. I leave in indonesia, here on my country, the intelectual property are not apreciated well. it's a country which ranking number 1 in corruption, and number 3 on piracy. i appreciate your comments.
