rather can she file seperate if they are getting a divorce the reason being is he has a child from someone else and he is greatly behind and she doesnt want them to take all her taxes for that
is she right by wanting to file seperate

She can always file separately, but it is important to note that the filing status of "married filing separately" will generally result in her paying more taxes. See my previous post on claiming the credit for child and dependent care expense. "Married and filing separately" would result in a much higher tax bill for your sister. This should be avoided if at all possible. I understand her situation, but it is possible she could qualify to file as Head of Household as I stated in my response to part 1 of your question.

She needs to really talk to her lawyer about this. She could be treading on deep water about hording money before the marriage is over. Even if this is her earnings. Please have her talk to a lawyer. You don't want to see her losing that money and getting into trouble. Because I don't think your suppose to hide money during a divorce.
