Would you call it rape?, Or is it consent?

One night, a girl went out to a bar and had several drinks with friends. This one guy who the girl had flirted with offered to give her a ride home, and she accepted. They walked into her apartment and she immediately went to bed and passed out. The next thing she know, she woke up and he then penetrated her. She was too shocked to say anything or to tell him to stop. Since She did not tell him to stop does this mean she consented? After about 30 seconds he got off of being on top of her, and she immediately went out of the room and came back and told him to leave. The next morning she laid on the floor for about 3 hours in the fetal position sobbing her eyes out. Is this date rape or a one-night-stand?

How has that been accidental? He obviously knew what he was doing, and the fact that she was, well, UNCONCIOUS, should have told him he was doing something wrong, shouldn't it?

That's rape. Not saying no doesn't imply consent, in any way, shape or form. And anyone who tries to argue differently should be taken out behind the barn, if you get my drift. There was no consent. The law is very, very clear cut on this. No consent = rape. That is all there is to it.

This is rape. It's clear cut and not debatable. There was no consent because she was passed out. She wasn't even given a choice or a chance to consent. This man took advantage, raped her, and should be prosecuted. To play the devil's advocate, here, I have to say that this girl showed very poor judgement. She was intoxicated to the point of blacking out, accepted a ride from someone she did not know well, and then let him into her apartment. But before anyone thinks that this means she "asked for it", let me say that even under these circumstances the girl did not consent and she was raped. I'm just giving an example of some of the things for females to be aware of when considering their personal safety, in order to avoid being taken advantage of.
