Retrenchment

My former employer dissolved our unit, in effect putting me in a floating status. They are willing to pay my salary even though I wasn't doing anything just to avoid paying the law-prescribed separation pay. The situation was making me feel uneasy so I decided to find a new job. I know I'm no longer entitled to a separation pay because I resigned. I just want to hear your opinion on cases like this. Thanks!

I'm just wondering... what particular company unit is that? and why did they dissolve it? is their reason in its dissolution have something to do with computerization? If so, the company has the right to dissolve a unit... but maybe, they are just trying to look for a suitable position for you back then... just that you were not able to wait. Because I personally don't believe that a company would be willing to pay for higher costs of maintaining somebody who is not doing anything until his retirement days, rather than paying the employee off at the earliset possible time so they can get rid of further costs in maintaining idle employees. Because in maintaining employees, there are lots of multiplying effects... among these are social security benefits, health, bonuses, and the inevitable mandatory retirement benefits come the employee's retirement age.

They're buying time. They won't keep me until my retirement day. Yup, they're trying to find a suitable position for me, outside of the company. The dissolution has nothing to do with computerization. It is an IT company. I admit the reason is valid, the unit is not meeting revenue target. My case is a case of who will surrender first. I spent more than 12 years with the company. That means a huge separation pay, had I been paid.

You may seek assistance from NLRC. They are inclined to help the members of the labor force whose rights were abused by employers. Good luck.

They can only do that for so long can't they? Then they either have to lay you off or pay the separation. Doesn't matter, I can't say that I blame you. I wouldn't have felt comfortable about it either, but still, it is almost as though they put you in a bad situation and waited for you to resign. Not right at all.

That's hard for you. Asks help from agencies about such kind of abuse I know they will listen your case or ask some media person to help you they know more sources on how you can get your separation pay.

knowing your situation, it really is unfair. you deserve to get a separation pay. anyways, congrats to your new job. i hope your new employer will treat you well :)
