Blinking boston bomb scare - in the name security or fear

when adult swim stuck some illuminated elcetric devices or bridges in nine different cities, not a peep was made. But when the publicity stunt for aqua teen hunger Force was done in Boston, it resulted in a bomb scare. the man who setup the devices, acting on behalf of his employer, was arrested for the placing a hoax device - a felony and an account of disorderly conduct. is this penalisation warranted, or is it simply fear based? wher should the line be drawn between whats resonable or provocative entertainment and national security? is everything subject to questioning, or should there be some kind of boundary established?
