Do you think that people in the United States can sue telemarketers?

What is your take on this? I would like to know. I was sent this article on the man who is suing telemarketing companies for calling him when he didn't want them to. What would you do? Would you do this as well?
Take a look at this article and read it, and then tell me what you think.

I think it is possible to sue telemarketing companies but it may be difficult to prove in some cases and the chances of winning might be slim. If I told the company to stop calling me and they did not, then yes I would sue them. Some telemarketing companies constantly call people after being told to stop so something should be done about it. That is great this person received $3500 and hope that company learned its lesson.

I think that if I had them harassing me on a constant basis and after telling them to stop calling that I may end up doing the same thing. It would be nice to have the extra cash as well.
However, they are a business and are trying to make money just like any other company out there, so they have to be doing something right somewhere down the line. This type of thing really makes you think in a way. Right?
Anyways, thanks for your response.

I think this should be something open to all victims of Telemarketers no matter whether they are in the USA or else where in the world.
All I say good on the man suing! Lets hope it teached the people in question a very valuable lesson!

I am hoping so as well, but it probably hasn't. You know how these telemarketers can be...pushy...arrogant...persistent...etc. They will probably do this until a law gets passed that states that they have to do this or else. Who knows?
Thanks for your post. I appreciate it.

u can have yourself put on a no call list, and if your on this list and a telemarketer calls you you have every right to sue them!

I have registered my telephone number with the National Do Not Call List and at least the number of telemarketers has decreased, but not stopped. I was hoping it would work for all of them, but no such luck.
It would be nice to not have to go to such extremes to get these people to stop calling. The trouble is that some of them don't take no for an answer. Some of them get you on the phone then refuse to allow you off of the phone. I hate getting rude with people, but when it comes to this type of telemarketer, they leave me no choice.
Other telemarketers repeatedly call, no matter how many times I have told them I am not interested, and not to call back again. They don't seem to care. I even had the same one call me back three times in one day, and yes, I recognized the voice!
Still others are the automated ones. These are really aggravating, because if you hang up on the machine to quickly, it just calls you back! They seem to call over and over, and you can't even tell them to stop.
I'm ready to start suing them if this National Do Not Call List doesn't work. I guess it gives me another option, after reporting a few more of these calls that are still coming in, if they don't stop I may consider suing them.

Kelly,
I think that I would do the same. I had heard from a few people that telemarketing companies have gotten new numbers from this list. I don't know how true this, but I think that this could be something that has happened to some people. Another thing is that whenever you sign up for something, such as getting a new telephone number, getting a new cell phone, etc., the company will sell a list of the numbers to these companies so they can call you. This is wrong and should be stopped. If a company wants to do this, they should ask permission from the person who has that number, instead of just selling the names and numbers for a profit.
Anyways, if I were you, I would be looking into doing this. Maybe you could make some good money for yourself from the time that you have to take out of your day for having to tell them over and over again to stop calling. Good luck!

Yes they do it all the time. You have to sign up with the National Do Not Call Registry https://www.donotcall.gov/default.aspx then register your home number and cell number, if they keep calling you, you report each incident. I have herd of people going to civil court and filing suit.

I know about the National Do Not Call List, but I have never read about anyone actually suing them. I, for one, have not ever used this list, but that is only because I don't have a home phone and my cell phone is through Verizon. Verizon Wireless subscribers don't get telemarketing calls due to Verizon stopping this from happening.

i think you can definetly sure there are marketing laws that these companies need to follow, just like any person or business you break the law you may get punished

That is true as well. They need to follow the laws, as any other business would have to do. Thanks for your response.

I've been on the Do Not Call list in my state for about 5 years now - and am pleased to say telemarketers no long harass me lol. Although did get a call a couple of from a SUPPOSED charitable organization - I say supposed because I had never heard of it before. I politely told them I wasn't interested and was on the do not call list - that is when they told me that didn't apply to charitable organizations. I then none to politely told them I didn't care - I didn't ask to be contacted. After be told that I couldn't stop them, I informed the caller I had their organization's name and phone number on my caller ID and if they called again I would report them to my state's Attorney General for harassment. They slammed the phone down in my ear and not another peep out of them LOL.

yes you can sue telemarketers in the USA... if you are on the national do not list then you can sue them. I think the company pays you damages. but the national do not call list only applies to telemarketers and not research companies... research companies are like people calling your house asking questions...
