TMZ has learned that Kevin Federline has asked a judge for an emergency hearing on Thursday to discuss his custody dispute with estranged wife Britney Spears.
A court spokesperson says only K-Fed and his attorney are scheduled to appear before the judge, but adds "anything is possible."
Federline filed papers in November seeking spousal support and sole custody of the couple's children- 5-month-old Jayden James and 17-month-old Sean Preston. As TMZ previously reported, a temporary court order granted the couple joint custody, with Spears having primary physical custody of the boys.
Now, with Spears' recent erratic behavior, coupled with the fact that she's been in and out of rehab twice in the last week, all bets may be off.

Britney should definitely not have custody of those kids until she straightens herself out, that's for sure. I don't know how much better off they would be with Federline, though. It's quite a toss-up. I think that he's simply trying to get his hands on the support money. Why doesn't the judge consider placing them with Britney's mother temporarily? Since there are doubts and issues about both parents, wouldn't this make the most sense?

Erratic behavior must have run in the marriage. Both have not exactly been known for their sanity and common sense, but are either ready for the responsibility of raising of the lads? Or will they use the money they have coupled with whatever support the other will be forced to give so they can hire someone to raise the children for them. This way,Brittany can go dancing and K-Fed can return to the wrestling ring(or whatever he is doing now,as long as it is not singing).

I never could have believed I would come to the conclusion that the kids would be better off with him, but they just may be. Actually, I think maybe some grandparents should step in and take custody of them and MAYBE just maybe they would have a chance at some normalcy. Do these people not care about their children?

Wow, it's a tossup. Give them to the woman who holds them 10 minutes a day, shaves her head, tries to kill herself and parties every day or... Give them to the Doobie Ghetto Boy who'll father 19 more children before the kids are 3 years old.
