what to do if some pblications used your photo without credits to photographer!!

Do you experienced that your photo are used in some print magazine and not putting your name to that photo as you are the photographer of that imaged... If? what do you do and what necessary thing to do in order not to happen it again? Since it was happen to me and till now i don't know what necessary action to start with...

I guess you get it signed and in writing that you will agree to let the publication use the photo only with the photographer's name on the picture. It's the least they can do if you aren't getting paid for it. I don't think anything can be done after the fact with just a verbal agreement.

First how how did they acquire your photo? Did they buy it online? If they did there are different types of usage licenses that can be bought concerning the photos. If they bought the photo with all rights then they can basically do what they want with it. And they don't have to use your name as the photographer. There are licenses that give limited rights to the buyer and then there are those that allow a one time usage. I'm sure there are more. You should check out just what the agreement is if somone buys your photos. If they are used illegally then you should get a lawyer and find out what can be done to stop it. If you just gave it to them with no terms written then they can do what they want with your photo.

See if they will write the agreement out about listing you as the photographer. That way you have something to go on if they continue to do this to you. have it notorized or signed by witnesses.

Actually I give my photo to them and have only a verbal agreement that if they will used my photo, please included my name since i'm only building up a reputation in this field since I trust them that they will do that... and as what you said I think i will talk again to them for clarificaton....

When I submit a Photo to a newspaper for them to purchase I state up front that I retain the copyright and allrights to the photo. I state that they have the rights, for the price stated, to use the photo in their paper or papers and I am to get credit in the caption for the photo. I also state wheather it is an exclusive right or not.

My first response would be to ask how they got the photo? If you gave it to them to use and didn't get it in writing that they would use your name, then you have no recourse. If they got the photo illegally, you should be able to prove that it's your photo and confront them with that fact. From there you can get money and a byline.
Either way, you need to contact them and ask them to please include your name in a correction.

If you are doing it online it is always a must to review the Terms of Agreement before contributing your photo, take time to read it and pay attention to the clause wherein they are stating their condition how they handle the "royalty fee" , "intellectual rights" or "copyrighting thing". With this you will be aware where will your photo be used and you can even consider what other possibilty might happen.
On the other hand, doing it offline is more sensitive. I suggest you ask a written agreement or contract how they will use your photo..
It is always a good thing to prepare and ask for a black and white rather than do the business verbally without written docs or agreement.

You can contact them and ask them to stop, because they are using copyright material.
You can ask them to pay you.
You can ask them to as least put your name on it.
I can't believe how a magazine would not know better than that.
