Work without Overtime Pay

Is this legal or illegal? There's this establishment here in my place that I know who doesn't pay their employees when they work overtime. They are underpay and they aren't paid right when they work overtime. One of the reasons why I am thinking twice if I'm going to work there or not is because of the situation. My friend who works as a programmer told me his salary is not enough that's why he's planning to move somewhere else where he can get enough of what he deserves. What's your stand in this work without overtime pay thing?
