I read in my local paper about a lawsuit involving three Gentlemen with similar Names, who are fighting to say they was a Ford Mustang announce on the local news. The Ballot in question has one of the man's name and call number. However, since the cellphine number is not listed in the phone book, and the number is unlisted the judge feels their was no public record of the number and thus no ability to show the number belonged to the man who claimed to have filled out the ballot. So the judge has ruled the vehicle must be sold at auction and the profits be split three ways. Also the news show will no longer be doing that type of draw again. My Question is should this lawsuit even happen? Was the judge write or wrong? Why is the world so greedy?

Wow, In all of the draws or contests this had to happen. I think the judge was right to do so. Simply because there was no full proof which should have provided and since this was the result with three men with the same name. Heck, what else could've been done. Split the winnings three ways makes sense to me. Auctioning off the vehicle was also a good idea. The world is so greedy because that's how most of us feel it necessary, it how we as a society has conditioned ourselves,.. a shame really! Don't understand it myself. When i look in the mirror I'm not thinking about how I going to stiff somebody else for his wallet because it happened to me. My minds a blank every morning. Not sure why? I never let it be the bane of my existance really. it's not necessary to think of all the things you can get away with. Such a sad shame though... how we've conditioned ourselves throughout the years,... leaving our moral and ethics behind to make money the number one thing in our lives. Where did we go wrong? Thank you for your discussion, i had lots of answering.

I agree somewhat, but the gentleman who could pove it was his phone should have gotten it, for it was his phone number even though it was a cell. I am happy I have a unique name so I do not go though that mess.

Did all three men enter the draw? How did the news announce the prize winner? If they just stated the name then I can see the lawsuit, but if they announced the name and part or all of the phone number than I disagree with the lawsuit. The world is very greedy, but this is beyond greedy and the judge was wrong...the phone # does not need to be public record to prove it belongs to a person.

The lawsuit should not have happened it is a waste of the courts, yet at the same time if all three men filled out entry forms for this contest they all have the right to win. However there is some record of the cell phone number as the man can simply show his phone bill as proof that the phone belonged to him, the phone bill will have his address etc on it. While it is not necessarily a public record there is documentation to verify whose phone number it is and I can't understand why the person who had this phone number didn't bother using that as evidence. That would make the situation suspect. As for the entry form, if all three men filled it out with out proper contact information then as far as I am concerned none of them should be eligible for the prize and a new drawing for the vehicle should be done.
