Have you ever had people just back out into traffic without bothering to check if it was safe? That is something that irratates me. Why do some people assume that all traffic should stop for them?
Driving down the highway yeasterday, speed limit clearly marked 45 a car backed out in front of me without even looking. There was nothing around to block this persons view, they just didn't look. I barely missed hitting them. If I had hit them whos fault would it have been? His because he didn't look before backing out/ Or mine because I bfailed to avoid an accident?

Oh boy, do I know what you mean ! I often wonder how some people managed to pass their road test LOL.
I don't claim to be the worlds best driver but I am more cautious than some.
You asked a very good question...who would get the ticket?? Common sense would be for the other driver to get fined since he didn't look buuuut often times common sense doesn't prevail. I find pedestrians just as careless at times. Nothing bothers me more than when your driving in the city and someone darts out from parked cars and proceeds to cross the road without using a crosswalk. Same thing...if you hit the pedestrian you get charged.
Well I know who will get charged if I ever run into someone who backs out without looking...ME. If I didn't get charged for the crash I'm sure I wouold for verbal abuse. LOOL

Some drivers are all over the place and they don’t seem to realise that they are supposed to stay in between those white dashed lines. One example of this that I find particularly scary is the old two-lane roundabout scenario. When you move on to the roundabout to turn right, you have a car to your left that is going straight over. Instead of following their lane round the outside of the roundabout, they take the shortest path straight across through your lane causing you to hold back in case they hit you. Absolute madness, you really have to be on your guard against this kind of thing. It’s fair enough if you are a long wheelbase vehicle such as a lorry, but there is no excuse for a car doing this kind of thing.Tailgaters that don’t get their way will often resort to undertaking if they can. Yes, I know that there are also those selfish individuals out there that hog the middle and the outside lane. They have no idea that there is a queue of traffic waiting to get past them, probably because they are in their own little world thinking about what to have for dinner. This causes some individuals to loose patience and undertake. Some drivers don’t even bother with overtaking and just carry on up the inside as if it was the most natural thing in the world to do, but it is a very dangerous manoeuvre for all concerned.

I have had this happen to me numerous times. I have no idea why people would not look before backing out. I think if you hit anyone in the rear even if they are backing up the law states it is your fault. This is a stupid law since I have seen many fender benders where the one backing up caused the problem. I always look a few times before I back up but I have almost been plowed only because I did not see anyone, I guess I had a blind spot. So maybethere can be a blind spot that the oncoming driver does not see.

This happened quite a lot, when I was living in a larger city. Seemed like a lot of people were just driving around "in their own little world," completely oblivious to the notion that other people were using the road.
My favorite kind (NOT!) were the people who would pull out into the middle of a neighborhood intersection and THEN look to see if traffic was coming. It almost seemed as if they were operating on the idea that "I'm going on the assumption that there will be no traffic, but I can hit my brakes if there IS a car." Really dangerous attitude. I saw someone get T-boned doing that, no more than 100 yards ahead of me.

Its just that some people are not careful when crossing the road, they just feel they want to save their time. If you had hit them, some people must have said; it was your fault. thanks and have a nice day.

It also amazes me the way people drive. While I have never had anyone back out into triffic when I have been driving, the biggest traffic risk in my area is people running red lights.
When your light turns green, there is no way that you just go ahead and go... you still have to look both ways. And if you are coming to an intersection and you see it turn yellow... well you had better go because the guy that is right out your butt behind you is going... And if you don't go you are getting rear ended.
I drive a fairly older car, and sometimes I wish that it was legal for me to just T-Bone people when I see them running red lights. It is amazing the way that people drive... And I am sure we don't even have to get started about people on cell phones.

this is so infuriating!
my mother lives on a road that you have to back out of. i always cringe when it comes time to get into the lane of traffic.
as far as fault goes, i wouldn't know the answer for sure, but if it happened to me, i would surely fight it in court!

This is what seriously irritates me also pal,i jus cant take drivers who think they own the road and jus drive how they like..I hate people who drive slow in the fast lane,and jus turn without bothering to look about....As for me,i think the government should do something abt such drivers!

Its hard to tell these days who the would give the ticket too. Yes, clearly this person should have looked before backing out but also you could be blamed because you wasn't being cautious enough. I often get sick of having to be a defensive driver its just easier to assume that the other person behind the wheel isn't going to pay attention to anyone else.
