death sentence for the rapists

if a girl or woman is raped by a man who is hiv possitive & gets infected by aids,in that case shouldn't be the rapist sentenced to death?if he is not sentenced to death isn't the law & order forgiving a murderer?may be hiv viruses can be carried out to other inosent people of the society.
