The death penalty must be legalized?

The death penalty must be legalized? With certainly each in case that it must be analized in different ways. Is has also who defends the penalty of death only for recidivits. And you? What do you say?

I don't agree with it. But in certain cases I would probably actually agree with it - particularly rape and child molestation. But I would much rather see sick people rot in jail, without TV's or any luxuries.
