Adding music on Mylot site, How? What about copyright infringement?

Greetings to all.. I have been away the past few days and I appreciate hearing from friends who miss chatting...thanks for letting me know that. I miss all of you too! Anyway, hope to be catching up to previous discussions...and decided to past a few new ones while I am here. OK...here is the first one. I notice that some members have music on their sites. My first question is how do that? It is enough for me to have set up my site...and it hasn't changed in the nearly 9 months I've been here. If I do decide to add some public domain music I'd appreciate knowing how to do it if anyone would care to enlighten me. Thanks in advance. Secondly, what about copyright infringement? How are we allowed to do that on Mylot without infringing on copyrights? It is my understanding that no one is supposed to use anything someone else has produced without written consent. As a writer I am always concerned about that with my work. I am equally as protective of other writers, artists, photographers and musicians as well. Not that I am trying to create problems here...in fact I am looking to avoid them...and make sure other members do not have any as well. For example it was in the news today that a woman in Minnesota was found guilty during her trial. Evidently she had 1,900 music files she had downloaded onto her computer. The jury said she had infringed on the copyrights and awarded the record companies. She has been fined $220,000. So when members use music files and put them on their sites isn't there reason for concern? Or has Mylot allowed this somehow? Or...do members who do it not know...are are just not concerned about it? Thanks for chatting with me about this...good to be back.. Raia

My music is someone very near and dear to my heart in fact he has it. His stuff is original and if not he has permission to use it. He posted in on reverbnation and it gives you the option on their to link the music to other sites. I'm not sure that copyright infringement rights apply to music sites like this or my playlist but I'm not sure. I just thought I'd throw you a response and if you want to listen to a great voice check out my profile. :) Have a great one Raia- hope all is well!

Hello again.. Missed not being here...and hope to catch up this weekend. Thanks for your prompt reply and when I was on your site I did enjoy the great voice. I appreciate knowing about sites that will allow us to link music to other sites. David is going to do a little more investigation on this because from his experience many record companies, producers and musicians are very protective of their interests and do not take infringement lightly when they find out about it. Things are going well here..think I my body is trying to prevent a full blown cold or flu from happening...lot of it out there. Other than that we are good. Let me know how you make out with resolving the issue with your 'friend.' Checked back but you hadn't added anything more. I am sure you will handle it well. My thoughts and well wishes are with you. That "friend" has been avoiding me like the plague..maybe next Wednesday or so. In any event I will post the resolution under your response. It's killing me- it's hanging over my head though it shouldn't be so I really do need to resolve that. I'm glad you enjoyed the music, it sounds better live but it's all I have for my cyber sisters. Coincidentally, one of those songs is all mine- so dreamy! :) I hope that you don't get sick, it's really brutal this year. So stay well! I should be around today between mylot, epinions, and helium, there is some writing that I'm itching to do. Hope your around and have a great day!

Hi thanks for the update on the situation with the gossipy 'friend." I appreciate how you feel...I like to resolve things and then let them go. Energy like this can create a stifling effect and I hope that you will be able to find a way to speak your mind and that she has the courage to own her stuff. In any case I trust you will use your intuitive and be able to harmonize the situation. I am still unsure about this business of posting music on our sites without written authorization from the producers and/or artists. When people take them from play-lists that still doesn't mean that they have a right to take it. It is still my understanding that the copyrights are what they sat...there is a right...to those copies..and anyone who does not own the creation does not have any right to it unless otherwise stated. I need to investigate this more before I will be using anyone else's material on my site. Thanks for your input...and I like your music choices and the fact that you have a right to use it. Enjoy your weekend too. Sipping ginger tea and holding the bug at bay for now. Talk soon.. Raia

Hmmm good question Raia as I am currently using playlist on my profile page but have never thought to check whether I was infringing copyright. I also copy youtube videos too so umm not sure on that one either. I also was forwarded one of Jamie Olivers chefs book in word format that was accidently forward to friends so the email says. It has been circulating the internet and a friend sent me a copy of it too. I decided not to send it on because I thought that it wasn't fair for the owner not getting paid for his hard written work. The same goes for the book that I downloaded from Oprah.com of suzy Ormans latest one (sorry forgot title) a friend wanted me to send it to her but I said no because of copyright issues and that she would have to download it herself. Isn't it odd I do it for some things and not others. I don't know why that is either, I think I'm weird like that.

Hi and thanks for your input and experiences. After reading the responses to this discussion so far it is clear to me that there is a lack of clarity about the question of copyright infringement. Skinnychick asked me to update this topic and so I posted a second one to hopefully clarify things for members. As a professional writer I am very sensitive to copyright infringement. I respect the fact that you paused and reconsidered your choices around circulating written material that the writer 'owns.' Even though people do abuse artist's rights all the time it still doesn't make it legal to do so. Many do it out of a lack of forethought or understanding and that is what prompted me to open the floor for discussion. If you check out the other discussion on the legalities of it things might be a little clearer. Basically it is not so much HOW the music is obtained but WHAT people are doing with it. Just because a person pays for a song...it does not give them the right to give it away to anyone else. Every movie, book and song label specifically says...'not to be reproduced without written consent.' I would feel safe in saying all these playlists do not have written consent to be putting all that music out there for others to reproduce...and reproduce and reproduce without any reimbursement for any of it. Interesting social and ethical questions alright. Thanks for your participation again my friend. Raia

You know, I hadn't thought about the copyright issue. The music player on my site comes from projectplaylist.com. Basically what Project Playlist does is provide a search engine for links to music online, and then let you create a playlist of that music. The music isn't actually hosted by project playlist, it just provides the links and creates the player. I hadn't thought about the legal implications until you posted this, but I went to the site to look, now that I'm thinking about it. The site for the player I use claims that it's not illegal because it honors the wishes of artists who say a link is illegal and ask for it to be taken down. A lot of the links are to promotional sites owned by the artists or record companies themselves, so it's music that they provided for free anyways. Now, I'm not stupid. I'm aware that just because they take it down if asked doesn't mean that they never have illegal links up, or that I can't be using any illegal links. However, since it seems they're making an effort to comply with the wishes of the artists, that's better than some places.

Hi Lecanis... I originally posted this as a query about how to add music...and the infringement question. Then as I read a few responses here I could see that members appear to be under the erroneous belief that taking music from a play list is acceptable. That prompted me to post a second discussion outlining more of what I found out. Whiteheather posted a link you might want to check out. As a writer I am very sensitive to this issue. Basically what anyone produces is THEIRS. No one has a right to use it or take it without written permission. However, many take that a lightly either by choice or through a lack of awareness. Thanks for adding your input and experiences. Raia

Hello my perspective friend. I am always interested in the music uploaded at those profiles, but since you have mentioned about the copyright infringement, I think that it is better for me not to have music at my profile so that there will be no trouble coming later on. Better cautious than never. But to know that way of adding music on Mylot site still interests me. Thanks.

Hi again my friend.. Thanks for your input. My views are like yours...I will not take anyone's music until I know I have a right to do so. Pyewacket mentioned taking it from play lists...but just because someone else posted it on their play list does not mean they have a right to it either. Yes...we need to make informed decisions in life...and this is a good example of how some act without thinking it through...or even questioning it. Being a writer I am very sensitive to copyright infringement. Talk soon...so long for now.. Raia

It is copyright infrigment if the person does not have the written rights to play the music in a pyblic venue. Many people loose sight of the fact that a person "created something that is theirs" When they copyright anyhting they are saying it is mine and I will decide where it gets used. Most of us have forgotten this principle as averything is so easy to get on the Internet. We no longer use words like theft or stealing. It is now I paid for it once and its mine or who cares. The person who made it does. I know this from experience as I used to develop software. But found "Piracy" just did not make it a worthwile venture. So you can put all the rationalations about copyright material you want. Unless you have express permission to share or use the material it is "THEFT"

Hello again Remo.. I appreciate the fact that you dropped by and are telling it like it really is...whether people like the terms or not. In our society there is so much concern for 'political correctness' that people often soften their terminology. You put it very succinctly and to the point in your closing comment..."So you can put all the rationalations about copyright material you want. Unless you have express permission to share or use the material it is "THEFT" Thanks for your blunt reply...gives a person reason to pause and think. Raia

It is probably not legal but does that mean someone my come after you probably not. But then again there is that lady in Minnisota that was tapgged for $220 big ones. So as anything in life you take your chances

Yes...that one is a good example alright. I am sure she never thought she'd ever be prosecuted and fined because she was downloading the music for herself. Yep...she took a chance...and now has some serious consequences to contend with. Thanks for your input. Raia
