Brain damaged woman sued by Wal-Mart

Ok, so this poor lady is an employee at WM and buys into their healthcare plan. She gets in an accident, is left brain damaged and in a wheel chair. She gets money awarded to it, which she needs to pay for care for the rest of her life. What does Wal-Mart do -- they go after that money to recoup the money they spent paying for her medical bill. http://www.cnn.com/2008/US/03/25/walmart.insurance.battle/index.html?iref=mpstoryview BTW One of the woman's children died in Iraq. Is this one of the worse example of corporate America that you have heard?? What can we be done to bring humanity back to the big companies? What do you think about this situation?

I agree. Everyone should shop at Target instead. Then Walmart's profits will fall. I think I will tell all my friends. I will also email Walmart and let them know how crappy I think they are for their treatment of this poor unfortunate lady.

We do, but we can't afford the other stores. I have never heard of anything like this before though.

talk to one of the millionds of mom and pop stores they have put out of business ask what they think of wall mart or one of thier employees that get little benefits they can charge less cause they pay less!wall mart has put thousands out of work

My father used to always talk about the mom and pop stores that lost out to Walmart while he was still living. he never thought that was a good thing and with that lady's dillemma, that just isn't right. Come on, she need that money more than they ever will.

Well, I guess they don't want to pay the money. They are really stupid. It just makes them look bad. I actually shop them from time to time. I prefer other stores, but I like how some of their products are always there. You could always stop shopping there, or write to their corporate office to say that you're upset about what they're doing. It does seem terrible about that :(( Pablo

This is the kind of senselessness that makes my blood boil. It is unbelievable. They know that they have us over a barrel because of their low prices. There is no Wal-Mart close to me, but I buy things from them online all the time. This is horrible. Someone needs to just set up a fun for her and her family. Then to add insult to injury, he son his killed fighting for this stinking country. Only in America could a company get away with something so sleezy. This is a real shame. I hate for people in other countries to see how low we are capable of stooping.

Rozie, we aren't becoming - we are not corporate AMerica nor are we the government, we are possible victims of both of them. I to am embarrassed by how other people of the world perceive us, if they feel that these countries are the way they think.

I read that story this morning and I know a few people who work at Walmart so it didn't even surprise me. I don't think there's anything that can be done to bring humanity to big companies....it's all about the almighty dollar!

I would think someone should be able to call them on it. It is not right, what this woman has gone through and then be stripped of the few lousy dollars that the lawyers left her with...it is just plain wrong!

If she is mentally ill they should never do that to her why sue someone that is mentally ill and cannot think properly on what she's doing. I dont want to think that WalMart people are the ones who are mentally ill

Sam ain't just rolling over in his grave --- he is on a rotisserie. The poor man created an empire, his progeny created a monster. She is not emotionally ill, she has brain damage....2 very different things. But I just know one thing, Walmart got the gold....she got the shaft

If she was in an accident, the insurance will go back on the other person, if it is not her fault. We had that with my daughters accident. They fought with the insurance and who was paying what. We were never involved in any of it. It is sad. I think they should just leave you alone.

This is what the woman got in her settlement from the other people's insurance company, Wal-mart should go after the insurance company not the poor woman

I honestly think it is too late, humanity is unfasionable, it costs money. Crucialy, the imminent economic depression, in the long term, may well bring some kind of re assessment as the companies acting in this way will lose the battle to stay in business, however big they are blessed be

I responded to another discussion on this and a more detailed news article. The first thing to realize is that the Wal-Mart health care policy has a clause to it that any lawsuit winnings does have to go to paypack the health care put out by the company. It stated in the article this is a fairly standard clause in corporate health care plans. With this in mind the lawyer should have sued for far more so that they could repay Wal-Mart and have enough for the family. As much as I would like to say wal-mart is the villain here it's not. It's going by what they agreed to and what the family agreed to when they used the health insurance to pay for the expenses when they could have used their car insurance. Something they left out of this article that was in the last is the woman is in a private room at a nursing center. She had to lose her private nurse but still at this point has the private room. She doesn't need to have that. She could be like everyone else there and have a room mate which would cost less. Reading that article does not make the family look very good. The fact that he divorced her so she could get more from medicaid? Why isn't she getting medicare since she is disabled? She should be getting that not medicaid and if so it wouldn't matter if she's married or not. Also if she's as brain damaged as they let on then isn't her husband her legal guardian and if he's not then he has no say in the money what so ever. There are a lot of things in that to me make the family look like they are trying to have their cake and eat it too. Personally I think their lawyer is over paid considering he took over half the winnings in legal fees. That is a bit much and I would have that checked out first thing. I would also wonder why he didn't do a better job of getting more money for the family considering how much they are saying she lost out on. The courts would have awarded far more then a million dollars. It sounds like they settled cheap just to get money in hand.

I apologize for having started a similar discussion to this one because I hadn't seen this one before. I agree with you 100% that this is horrible and I've already decided to boycott Wal-Mart and I've already sent e-mails out to my friends and acquaintances and told my friends and family members about it. I'm afraid "humanity" no long exists in corporate America. This is fascism at its best. Annie

I do not shop at WalMart. I try to avoid major corporations as much as possible and shop at local or independent stores, even if it means paying a little extra. I know that my money is going to the people who deserve it.

Disgusting example of corporate greed. How can people be so cruel and greedy? The money that they paid for her medical bill is pocket change to them. So this is how they treat their employees. Unbelievable.

Exactly. I hope the poor woman comes out of it alright. Perhaps with enough bad PR, Wal-Mart will drop this ridiculous "lawsuit".

The best thing to do is vote with our dollars and shop somewhere else. You may think they are less expensive and save you money, but in reality, they cost us all more in the long run. Because of their pay practices (intentionally keeping employees below 40 hours to keep from having to pay benefits) and their healthcare plan a high percentage of their employees have to use government assistance. They even teach their employees to rely on it. That comes our of our pockets in taxes - so we end up paying more in the long run by shopping there. I try not to shop there very much. I still do once in a while and I hate it when I do.

I don't think it's Walmarts fault. I think it's the insurance company. It's in the policy that the company has the right to recoup medical expenses if an employee collects damages in a lawsuit. Walmart is not the bad guy here, it's the insurance carrier. Although, Walmart might like to settle with this woman to avoid the negative publicity they're getting.

This has been extensively covered on CNN's Anderson Copper's 360 and Walmart had SOOO many options open to them. They have a charitable where they give money away to needy people. The Walton Family have a foundation of thier own. Why is it the first thing the HR Deprtment does is say...oh you won a settlement lets recoup our losses on you and leave you with nothing.... Why can they not be charititable to one of thier own??!
