I have bought a cellphone just recently and it was a reconditioned phone..it has a warranty of 3 mos but i really want to refund my money already..i have been going back to that store for 3x and still they can't give me a decently working phone! ooh i really am pissed off with them! i want my money to be refunded but they are saying that they do not refund..why can't they just refund my money since they really can't give a decently working phone..i am really really angry with them..their store should be closed! they are fooling people..

What were the terms and condition when you purchased that second hand phone, Have you got the Bill and what are the terms in the Bill they issued you with the phone. If replacement term is there they will have to change the phone and If they say if the phone is not working they will refund then only they will refund. I think you can ask them to replace your phone with some other which works.

they do not have a registered official receipt which has terms and conditions so i will be insisting on a refund since i have changed the unit 3x already and still they cannot provide a better one so i will be definitely asking for a refund.

See, in this business, no ifs and buts work.
If they mention something in the beginning, they give it to you.
If they don't, they wont.
Keep it simple, else you'll have to bang your head @ their desk forever.

Hi Kaezy! I'm sorry to hear that but that's true. A lot of shops here do sell reconditioned phones and some do have hidden defects. I know it's really really expensive to but a brand new phone from a good store (i.e. nokia, semicon) but if your purpose is really just for communication, second hand phones can make the cut. It's really unfortunate sis but if they don't have a sign that says no refund, you can demand for it.
If you have the receipt, hopefully it is also written there that you've changed the phone 3 times already so you'd have proof that they did change it and write down the serial numbers if possible. They're usually persistent as most of them only think about the money and not the welfare of the consumer. I hope you'd get your money back and get another phone that works fine. Take care.

i really really pissed off with them..i will be really insisting on the refund..they so not have an official receipt which has the name of their store on it..their only receipt is the ones that can be purchased in the bookstores.

I believe your first mistake was buying a refurbished telephone. I would not trust any phone or computer that had been fixed. It is just not worth it. You will usually have some kind of trouble. And I would think,once you'd bought one, there is no refund for that. It's like buying 'as is'. They might keep giving you another refurbished phone but not a refund. I hope you are able to get it, but I doubt that they will. Doesn't sound like they are a very honest business. I'd try and buy a new phone myself.

i know it is really my mistake..i shouldn't have bought a phone like that..but really now i will be insisting on refunding my money because they can't give me a decently working one..so the heck with them! i will demand a refund!

I have experienced this kaezy_kulet, i think way back 2006. I bought a refurbish cellphone in a nearest store, it's nokia brand. Then someone called me on the phone then battery empty all the way. my goodness it's just a day old since i bought it, then i visit the store and complain then they change the battery. And i got another problem again, the signal is too bad. i cannot call, couldn't text, couldn't even received message from my client. I am really pissed of them, and i go back again, they are not paying attention to me anymore. I really felt sorry to myself.. I couldn't refund my money anymore.

Yup, u have every right to get a refund for the phone under the consumer rights, but provided u returned it in the time frame stated to u.. Anything after that, they are not obliged to take back the phone..
SInce it's a reconditioned phone, u have to prepare yourself for this kind of things to happen to your phone, because most ple will tend to sell it when it's not working properly.. Very seldom, ple will sell their phones for cash if it's still working fine..
SO next time, just dun buy anymore reconditioned phones because they are highly unreliable..

Your first problem is buying a refurbished phone. Anything refurbished is bad news and they do not have a refund policy. Most do have an exchange policy I beleive. You are pretty much duped into having this phone. Let this also be a lesson not to buy anything refurbished no matter the cost or how good it looks. You are going to pay for it in the long run.
The only thing I can suggest is to look over the contract, terms and conditions and see what it says in there on refurbished equipment. If it says NO REFUNDS you will not get one. If it says EXCHANGE ONLY then you have to exchange it. The only other thing thing that you can do is talk directly with the manager. Don't talk to the salespeople but the manager itself they might be able to help you more.
Also when you buy anything eltronic, whether it be cell phone, computer etc always know what you are signing and what you are getting into. I think these guys seen you coming on this one and that is why they duped you on a crappy phone that doesn't work.

Hi kaezy! That has always been the problem with re-conditioned cellphone. One of my nieces had the same problem as yours. Yes they are giving the cellphone at a cheap price but chances are you will lose more money in going back and forth to their shop because after few days, the cellphone will give you problem. And like you said, they will say they are not refunding. But I think as a consumer, you have the right to get your money refunded, if the item you got is not in good working condition.
In buying items, it is very important that we buy from legitimate shops, not the fly by night shops, here today and gone tomorrow. It is important that they issue official receipt. More importantly we have to know our rights as a consumer especially when we get some damaged or defective goods.
The Consumer Act of the Philippines is meant to protect the interest of the consumer,
and some of its objectives are the protection of consumers against deceptive, unfair and unconscionable sales acts and practices and also the provision of adequate rights and means of redress.
Manufacturers and Store owners should replace defective goods. The old policy of "No return, no exchange" does not apply today otherwise they are violating the Consumer Act. In your case you bought a defective product, and it seemed they are replacing the item with defective phone just the same. Tell the Shop-owner that you know your right as a consumer and you will be forced to bring the matter to DTI. If the manager or store representative still would not act on your complaint, proceed to the agency, which has jurisdiction over your case. Bring the necessary documents like complaint letter and a copy of your receipt. Of course you will have to spend some of your time here but if you really want to teach them a good lesson then proceed with the complaint

Well I don't think it is possible..
Check their terms, perhaps it is possible..
The only thing they can do is give you another phone with the same or lower value.. (Unless you pay more and get a more expensive phone)

It all depends on the terms that you bought the phone. If the store's policy is "no refunds" then we should be careful on what we buy with them. I hope you have proof of warranty, then you can inspect that and find a loophole to probably force them to give you a refund - something like them promising to fix your phone, but if they can't then that's their problem and you can sue them for that.

there is nothing stated on their store that they do not do refunds but the sales lady is saying that they will do no refunds..but i will not accept that verbal warning..i will be really insisting on a refund..

The same thing happened to me few months ago. Sad to say they just won't offer u a refund. The moment that the reconditioned phone is sold to you, it means you agreed to their terms and conditions. The best you can do right now is save few hundreds then choose a brand new phone as a replacement. I got a defective Nokia 1100. Defective in a sense that it's not openline and it can't be converted. I took me few days to come up with few bucks then they replaced it with a brand new 1200. I'm still using it now and this time it comes with an official warranty from Nokia.

i did that already i have added a few hundreds for an 3100 phone..since the store doesn't have any brand new phones it gave me no choice..i still had a reconditioned phone and i am now really not satisfied with the phone..i really want to refund my money and i will insist on doing so..

i personally went to the store and they had replaced the phone that i have purchased with them but it is still not working very good..when we are in the store checking for the phone there are no problems but once we arrived in our home i will find another problem..i will really refund my money and i will insist on it.

You would think after 3 attempts to get a decently working phone, they should have to give you your money back. It sounds to me like they know they have a bad product that they are selling, and that is why they don't want to give people's money back. They are hoping people will take the crappy phones, and then let it go when they break. It sounds like a very tacky business to me.

reconditioned phone? ickk.
where did you get it from? I worked for radioshack, and we could send it in / give a refund within a month but you also forfeit your contract. Basically you have to get a new one with a new phone.
But if there is a warranty id call the 1800 number and ask for a manager and tell them youve sent it in and it still doesnt work and you want a new one.
Radioshack would replace a reconditioned phone if it was sent in more than 3 times.
Seriously, call the warranty number and talk to someone that can help you because the store wont be able to considering you got it from a third party retailer..at least it seems like.
Just call and if they cant help you ask for thier manager and just keep going up the chain of managers until you can get someone who can help you.

yeah thats the philppines.in germany no big discussion they will refund it.here they will ask your choice.new one one money back.today its juts amazing what i did.i bought a jeans of my little girl last tuesday and she used friday so now when i looked at her the ways he walk very uncomfy so i return it without any problems but in pinas yes lots of people involved like are manager,supervisor and others. .dont give up dear.go there and show the guarantee papers.
