Are You SURE You Owe That Money?

Okay a heads up folks. I think at one time or another we have been plagued by being hounded for old debts and been hassled by numerous phone calls or getting letters from those annoying debt collector agencies. It could be an old, old debt from years ago that may be still "haunting" you. But do you REALLY owe it?
Many of the debt collection agencies out there are nothing but scams, and they often will even hound a person relentlessly for an old debt that was already paid. If you keep getting a phone call by any debt agency, do some homework and research first.
I have my answering machine on 24/7 and it acts like a Caller ID for me, as it allows me to at least know who is calling. Well tonight, I got a call from Portfolio Recovery, and yup a debt collection agency. I was planning on calling them tomorrow but then thought...whoa, let me look them up and sure enough I found them, but I also found out that they are one of the biggest scam agencies going.

Example Three: Portfolio Recovery Associates and other JUNK DEBT Collectors will try to engage an individual to start making good faith payments on a JUNK DEBT (A debt that has passed beyond the statute of limitation in your state and is NO LONGER Legally Collectable) These Good Faith Payments might be next to nothing of an already discounted debt. Why? Because as soon as you agree to make those next to nothing payments...
IT BECOMES A NEW AND LEGALLY BINDING DEBT.. THAT MEANS IT GOES ON YOUR CREDIT REPORT AND IT CAN BE COLLECTED IN A COURT OF LAW OR OTHER MEANS AVAILABLE to these JUNK DEBT BOTTOM FEEDERS.

So in other words...if you contact these people and make good faith payments on an old debt that might NOT even be valid anymore, once you make even one single payment, then it becomes a legally binding debt that you then have to pay in full.
Okay I have to admit, I do have an old debt with AT&T (I now use Verizon for my phone) but the so-called statue of limitation on this debt is long over with...in other words I no longer am legally obligated to pay it....now if I had made a phone call to this debt collection agency as I had originally planned on doing...bingo I'd be then legally obligated to pay the debt.
Now..and this is VERY important!! If you truly want to find out if you do indeed owe ANY old, outstanding debts, here's how you can find out. GET YOUR CREDIT REPORT! And I found out where you can get your full credit report for one hundred percent free.
I looked up the Financial Guru Suzie Orman's website...she has one section all about getting one's credit report absolutely free and you don't have to pay one cent for it...once you get the report, say from Equifax, it's available on-line for viewing for one full month, and one also has the option of printing up the entire thing..I did

Scroll down and you will see the link that will lead you on the road to getting your credit report for free.
Once you have your report, there is a section you can click that says "Collections" which means it will show up any old debts listed with debt collectors....and guess what? When I searched for my own old debts such as that old AT&T debt..IT WASN'T THERE, and NO mentioning of Portfolio Recovery.
Conclusions: It's an old, old debt whose statue of limitations has run out and I no longer owe that money...if I had, it would have been listed...so the whole Portfolio Recovery Collection agency is truly a scam
The only reason I'm passing this info to you is let's face it...if one is being hounded by debt collectors we might panic thinking OMG I owe that money...but like I said the best way to find out if you do...get that credit report.

Good information to give out, Pye. Also, that site FreeCreditReport.com is NOT free. They expect you to purchase a credit card maintenance program that will keep check of your cards' usage. They claim that it's a 30-day trial, but we all know that either we forget to cancel or the company doesn't process the cancelation and we still end up having to pay. So, everyone needs to know that they CAN get a truly free credit report. Also, you should get copies from ALL THREE agencies because things can be on one that aren't on another. You get one free copy once a year plus a free copy any time you are turned down for credit.

This place suzie orman lists, is AnnualCreditReport.com and it is free...I didn't have to pay a thing nor even have to enter any credit card info to later be surprised by an unauthorized deduction from my card....thank goodness. I never checked out FreeCreditReport.com though..With the AnnualCreditReport.com you can actually get a new report every four months or so. So one time can get from Equifax, the next time from Expirian, then the third time from TransUnion

Wow, that is very interesting information. I hope people take the time to read this because it sure could save them a lot of trouble. I've never had unpaid debts, but I had a call once saying I did. I thought for sure I had just forgotten about it, until I looked the place up. It was a while ago and I forget what I found out about the company, but next time they called I told them I could get them for fraud. LOL, they hung up on me. I did check my credit report once years ago and it had things on there that didn't involve me at all. Can you believe it actually had a relative's debt on my credit report? The site had a place where you could complain about errors, so I did and within a week they had taken that off my credit report. It's time I did that again. Thanks Pye!

I'm thinking of expanding this information and write an article up for Associated Content. I wrote to my old credit card company that I had to see if they can remove the "negative" status on my credit report....Those cards were paid up in full last year but because I had, had late payments it shows up as negative accounts

This is really important information. Yes, and if you are past so many years, isnt it also past the time that they can call you? Its good to always check because there is so much going on now. Sadly, there are so many crooked scams. I would also check amounts carefully to make sure its not an over charge. That they havent tacked onto any of the bills. Great post and happy my lottin!

well that's the way it's supposed to be that after a certain time no one can bug a person to collect an old debt, but these scam places are just it...scams and they tend to somehow hunt up old debts

Wow thanks for that information Pye. I actually went through Suzie Ormans website several months ago and got a copy of my free credit report too. It's good to know about this debt agency too. Thanks for the head up.

Her website is fantastic isn't it? Lot of great info. Some months ago she was on Oprah and as a "bonus" for listeners to the show one was able to go to the Oprah.com website and download Suzie Orman's entire book "Women and Money" all 274 pages of it for free...so you bet I downloaded it. It's no longer available

thanks for this informative post. I am aware of what happens when these people call you.
There is this company calling me everyday, Allied Interstate. The first time I answered, it was a recording stating that they were investigating an uncollected debt and to call this toll free number. I looked them up on the internet, and found the same thing that you did about them being a scam, and how they are badgering people over old credit, some of them have even been paid off.
So every time my phone rings, I check my caller ID and will not answer their call. Now, they have changed the number they are calling me from, and it just says Tele marketer.
I refuse to call these people, because I do not owe any debts at this time. I do know that my husband received a call months ago from a collector, concerning an AT&T bill. My husband at first denied that he owed the bill, then he remembered and started talking smart to the guy. The calls I am getting could be about that, but again, I will not call them back.
The problem I face is that my husband does not look at the caller ID, and grabs the phone on the first ring. He is not the type to say you have the wrong number and hang up, he has to find out why you are calling, what you want etc. I tell him all of the time to just hang up.
The people are relentless, they will not stop calling, at first they were calling at noon, now they are calling early in the morning, and sometimes at night.

{{PYE}} Wonderful helpful information here; I get so many calls a day I have
to bury the phone in my pillow on my couch..LOL! I too have an answering machine
that picks up all the idiot snarly hateful messages all day long, some of those
collection types are really nasty too; I don't talk to any of them anymore, I just
let them talk to my answering machine, which is set for a male voice automated
response..LOL! That alone throws some of them off, but these companies are so
nutty, they first call with one number, then when I don't answer it, they immeditaely
dial back with a totally different number and so right away for the same place
you've got two annoying ( YOU OWE, YOU OWE YOU OWE) type of badgering phone calls;
see why I bury my phone in the pillows??
They drive me nuts! When you are disability and things get out of hand, you
borrow money to try to get out of it, then you have borrow again to pay Paul,
then Peter and it just gets out of hand.
But thanks for all the helpful links {{much appreciated}} , I will be watching
very closely to see if that place is on any of my old debts;

Well like I said, one sure way whether you really owe any of those debts is to get that credit report...if nothing shows up in the collections section then you know you're being scammed. I'm so glad I looked up that info on the Portfolio Recovery to find out they are a scam. By LAW, debt collectors aren't supposed to hassle anymore with phone calls or letters..one can look all this up about Fair Debt Collection Act:

Man, I am going to have to save this discussion for when I am more able to absorb everything in it. I think we have dealt with this company. I have paid off a debt or two this year. I may have to find out what the statute of limitations is in my state. I would not mind, if there was not a ton of interest and faked out fees tacked on it.

I now always make it a habit to look into these so-called debt collection agencies to make sure they really are legit, or a scam..most are scams unfortunately

Great information I have never heard of Portfolio Recovery Associates. My mom owes 9K on a credit card and she has done everything to get out of paying. She is now in a nursing home and only is allowed 35 dollars a month for extra to live off of. She does not have money to pay off the credit card. I tried to make arrangements to make payments and they would not work with me. She was summoned to court but could not go because of being in the nursing home. The debt is all hers and thank goodness not mine.
The lawyer's office has called me to get it straightened out who is now trying to collect the debt. I have called them and they where suppose to send me the paper work for the doctor to sign that she is in a nursing home. Well guess what they have never called me back nor have they mailed me the papers. The debt is unpaid and will go unpaid. I am ashamed that mom let her credit card get so big but it was not my doing. She was living in my home rent free and I was paying for all of her food and board She was getting 6 hundred a month you would think one could play on that amount of money per month. The stupid part of this was she was not traveling or going any where she was staying at home and spending the money.
I found so much candy and that type of foods that she ordered because I would not have it in the house.
Oh well I was working full time and going to school.

I am sure the fees and interest is added up to close to 20K. It started at 9K and last I know it was 12K and that was three years ago.
I am ashamed of mom for doing what she did. She spent money willy nilly and did not think about who was going to pay them back. She has not taken responsibility for her actions. She has blamed it "The fees, and this and that" that is what angers me so much just say I spent the money and I screwed up. Mom will never do that no matter what you are talking about.

Never answer the phone if you get a 876 area code phone call.. it's a scam too but of a different sort. One thinks the area code is toll free, it's not..turns out it's from Jamaica. These jerks from that area code make calls for all sorts of reasons..the last one I had was to inform me I won something like $37 MILLION dollars...yeah, sure..the idea is that you call them back and they try to keep you on the phone as long as possible with all kind of mumble jumbo stuff. Then you're hit with a Hundred dollar phone bill...

so, what do you do if these places call your cell phone and it goes to ur voicemail. In the msg., they leave a file number and all the directions to access the account on the internet? I am asking because if they leave this information at the wrong phone number, someone can log in and get all your information to take your identity.

Many, many thanks for bringing this information out, as there are many people in that sistuation. I myself don't have any debts to worry about but many people have, I hope they will read your discussion and take heed. If any one comes to my door. I'll sent them off with an flea in their ears and I don't get phone calls like that, but if I do, they get the same treatment. Bright Blessings.

It's actually against the law here in America under the Fair Debt Collection Act for any debt collector to hassle a person, yet these jerks seem to think they can still get away with garbage.

well i thinks you don't need to panic too much !! if debt collectors go after you all because they claim you owe them. that is the more reason why you need to keep vita documents that may be relating to issues like that. if they come all one need do is to search for the document relating to the past payment and see if you are actually owing . And in a situation where you are , walk to their office and sort issues out on how you will make the payment . no cause for alarm!!

Whose panicking, I'm certainly not as I know my legal rights about this. As far as settling this supposed debt with the agency in person and go to their office...nope don't think so...they're in Virginia while I'm in New York...LOL

Those debt collection consolidation agencies that are supposed to help really don't help much either.
