Jailed and To Be Jailed Again

Hiya myLotters and friends! Former Philippine President and now Pampanga Representative Gloria Macapagal-Arroyo is still in a hospital arrest for alleged Election Sabotage filed against her and other accused by the Commission on Elections. Today, I just read about an Arrest Warrant is already out to safekeep the Former President and others including her husband and the former Comelec Chairman. The warrant is ordered by the Sandiganbayan over botched NBN-ZTE Deal. Funny question now raised, how will you arrest the person who is already jailed? ~~ NEILâ„¢~~

I don't get it. Did they really found the ex-president guilty of such accusations? Don't we have a major rule that "a person is innocent until found guilty" not "guilty until found innocent"? It's not that I am pro-Arroyo or what but I stick to the law. I still even don't get it why they would arrest her or put her to jail if she is not even found guilty of any of the accusations? Or am I too out-dated and she already is guilty as charged? Please correct me if I'm wrong.

our justice system states that when one commits or possibly committed a crime or violation of a certain law, he will be investigated first by the prosecution. if the prosecutor finds that there is PROBABLE CAUSE or the accused is PROBABLY GUILTY of the said act, the case will then raised to the COURT. once the case reached the COURT, the COURT will then issue an ARREST WARRANT to make sure he will be available everytime the COURT needs his appearance during the TRIAL period. at this point, he has the right to BAIL so he can be out of the jail but make sure he will appear during trials/hearing. remember that there are certain crimes that are not BAILABLE, those HEINOUS like murder, rape and ELECTION SABOTAGE, as our law states, is also a non-BAILABLE offense. the COURT will put the accused/case on TRIAL and only the COURT will determine if the accused is actually GUILTY BEYOND REASONABLE DOUBT. at this point, GMA is not yet found guilty and remains to be accused and trial is still on going. election sabotage is non-bailable and that made her in the custody of the authorities. she have to prove the court that she is not guilty of the offense.

sorry about the term i used. but once one is accused and arrested, as ordered by the court, he or she will be detained to a certain place. would you like it to be this way, detained and not jailed?

I know these things...but why the jail immediately? GMA is not going to jail yet until found guilty and is not yet in jail but in a custody.

i guess they are just making sure that GMA will no just go out of nowhere. whatever happens with her case before the regional court, she could not just escape. and to think, both cases are non-bailable so she has to face the trials and wait for the verdict.

Hello Neildc, I hope she doesn't run again ever, besides, her punishment is just the beginning. As long as she doesn't get away from our country. I feel sad for the people of Pampanga for actually voting for this woman and now who will work their duties as a representative of their district??. things messed up a bit.

LK, first, she could not make it again as the hospital guards are very much in control. not of course when something happened under. alphenor, we are not the law or the court that could tell a person guilty of the crime or offense he or she may have committed. let the court decide as the court deems to be the authority in determining one accused guilty or not, beyond doubts.

The votes of Kapampangans of District 4 were bought beforehand. CGMA spoils the people under her district using freebies and "relief goods", therefore made her gain control over their votes.

hello,when i see your words, i remember one sentence of "to be or not to be". This short sentence show more meaning what i want to talk about. it is from a great person. you may feel it is so simple a sentence, but i do not think it is as you feel. i agree this point.

yeah the jail she is in now is like a 5 star hotel suite for most of us Filipinos, this is just hospital arrest and involves a different case, now different cases could be filed against her like this one (ZTE deal), and might just land her to a different kind of jail or to be frank the Muntinglupa prison ( of course she is presumed innocent unless proven guilty), have you been or any of us here in mylot been their or seen it? I tell you that's the real deal

Sad that it happened to her. Prior to becoming the president and when she was just a senator and then VP, she was referred to as one of the best economists in the country. Unfortunately when she became the president she turned out to be greedy and power-hungry. Whatever is happening to her and her cohorts are just by-product of their excesses. Talk about karma. As to your question, she will be jailed, the only thing that is an issue here is whether she'll be put in a real jailhouse or somewhere more convenient for her (like house arrest).

neildc, I guess it's only for FORMALITIES. It is in the court protocol to send SubPoenas/Arrest Warrants to the respondents of the case. And I guess the trial courts and DOJ need to keep complete records of any trial - including Arrest Warrants.

i think it's not for formality but it's the law the states both parties should be notified everything that is within the case proceedings. meaning, if the complainant has the complaint papers, the accused or the respondent of the said case should also be notified regarding the accusations. arrest warrants though are not necessarily be sent to complainant but to whoever will serve it to the accused. in the case of GMA, the election sabotage case is another case separated and not related to the nbn-zte deal. if however one of the two cases will come to end and she will be acquitted, she still could not get out of jail if the other one is still in trial.

Agree how they arrest the person if already in jailed.But maybe will add the imprisonment for many years. By the way how are you? I hope you are doing well.Arroyo has been in big case ,but i don't know what they just finish it.

It is sad that a supposed leader of a nation, albeit a former one, is involved in criminal activities. It is those people that gives politicians a bad name. Being a politician is indeed noble if the aim of being one is to serve the people. But a lot of politicians in developing countries are corrupt and abusing their given power. Evils like them should be locked away in jail forever for taking from the poor.

maybe that is an additional case file so the length of stay behind a bar is added for more sentences in terms of years. though, even the ex. Estrada already serve his term and now a free man . this would happen the same with ex president Gloria. the Justice system here in the country have some flaws where the prosecutor could even be bribe and so is the other staff of the justice system is very slow in using the law in full force.

It is not only her but also other people who have some degree of involvement in that failed transaction. Her husband Mike had posted a bail for his case and I suppose, it includes the former president. It's really funny how these leaders of ours are playing like kids, trying to throw stones against each other in an attempt to show the public who is better. However, there is a lesson for every one to know and move on: there is a time for everything under the sun; a time to lead and a time to follow; a time to be free and a time to be jailed; a time to be happy and a time to be sad. Whatever it is that life throws at us, it happens for a reason. We can laugh at the calamity of others but God can see it and when it happens to us, others will also will shout for joy.
