It's going good then stupid people have to screw it up

I was just saying to a old coworker how its going good savings finally being put away, schooling, and was going to go view a mobile home Sunday. I was coming home from work, there is no stop signs for me for about 15 minutes on this road. I was driving and I thought I saw lights on this backroad, well here this lady flies through the stop sign and sided me. The guy behind her said she didn't even braka, and she was too busy reaching something in the backseat, and looking back. She had 3 kids in the back seat. There was about 3 witnesses that said it was her fault, she gets out and starts blaming me (yes she had the stop sign, went through it and sided me). I said about giving me her information for insurance purposes, I am putting it through insurance end of story. The guy behind me called the police, and they obviously will be awhile. I got all my papers out, and ready for the cop. She put on this show, even the guys and the woman coming the other way were siding with me, and telling her she was at the wrong. The cop shows up charged her, the 3 kids all weren't strapped in properly. The guy behind me said he would go to court and say he witnessed her looking back, and leaning back. Plus, running the stop sign, she put on this big show. I will be putting a claim in with my insurance, now when I do this it will fall back on her and well screw her insurance for many years. The cop recommended I do this, seeing she had many accidents in the past, and she kept saying how she had 3 kids, and it wasnt her fault. My car will most likely be wrote off with the damage, the front end right at the wheel, I need a new tire, it put it out of alighnment, depending if it snapped or just pushed it. Now my insurance wont cover a rental car (if it's wrote off) as I am under 25, so I have to find either a new car, or find someone to drive me, so I will make sure my insurance knows this, and put this against her, the loss and hassle it costs me to find my way around because of her. I ended up having to pay $400 in tow fees, the cop called an ambulance because my neck, and back, as well as hitting my head off the window (which I was shocked it didnt break). I am sitting here on a backbaord in the emerg waiting. The ambulance bill will probably be about $165 on top of that plus any medication. Plus, the ammbulance driver said I most likely will be off work for a week or more depending what the doctor says but with my medical history, seeing as the stress and my body in shock will cause more issues than the average person. I will bring this up to my insurance (but I dont have that coverage I dont think - personal physical damage), but I will bring it up in court.

I'm so sorry you were side swiped (I think that is what it's called). Maybe it is being T-boned. I don't know. Anyway, she is at fault and the cops documented it. I'm glad you are okay enough to be writing about it. Her insurance should pay for everything. I guess your company would sue hers. Than goodness you aren't hurt more than you were.

We have no fault insurance, so well in the end I get screwed because she's stupid. My insurance will pay for it (which is why I pay a few thousand for it). But my rates most likely will go up, they do consider she caused the accident, but the fact I was in the middle of it, goes against my insurance. I am putting a claim in against her, seeing as I went to the hospital. Her insurane will sky rocket, I am not sure what mine all covers I know I have a decent coverage. But the cop recommended me take her to court, for what my insurance doesn't cover. Also, aything else such as missed work, suffering, you name it. He said if I have to the period off work, which the doctor just came in. I have to go to the city for tests, something about an ultrasound and something with my head. He thinks it's fine, but because I am in pain, my head hurts (obvious), and just feeling sick he wants to double check (we don't have any of that here) so i'm not sure if I have to pay for that transfer to that hospital or not. I have to get my bowels checked, and reproductive checked seeing my history any small preassure can cause damage so they arn't sure how hard I hit it, I have marks from the seat belt, but it also locked up, and pushed into my abdomen, and it hurts there. I wonder if I will be out by 9am to go to work. The doctor laughted when I asked.

Ricki, may I suggest that you keep a diary of any and all symptoms you have from injuries sustained in the collision? That is one of the things that my lawyer is having me do, as he believes we're going to have to take my case to litigation. It doesn't have to be anything elaborate. I usually wind up writing something like "My pain level was 9/10 this morning. Took 50mg tramadol at 6:00am and by 7:30am pain was reduced to 6/10. Daughter wanted me to pick her up this afternoon; I did, but had to put her down within a few minutes because of back pain. Left my evening photography class after half an hour because standing/walking around the darkroom while making prints was too painful." You can include notes about medical appointments and expenses, and lost wages too. Please don't drag yourself in to work tomorrow morning if they release you before your shift. You're probably going to be pretty sore for a few days even if there's no major lasting damage done. Take it easy for a few days so you can heal. Your work ethic is amazing, but your health should always come before the jobs.

I'm with Renkin on this Ricki. Your health comes first. You may have aches and pains you didn't even know you had after sleeping awhile. Take it easy. We have no fault too I think.

Well this is a big putback. I hope that you don't have any long lasting reprecussions health wise because of this accident. You will win the court case though because of her history, because of the witnesses... In fact it wouldn't surprise me if she didn't end up in jail for for negligence with the kids as they were not buckled up. Not sure how the laws are there though. It is money up front, but I think you will be compensated for it by the court's decision. Her insurance should pay for damage to your car, shouldn't it?

oh ricki I am so sorry aou got sideswiped and from all you wrote she is completely at fault. You may have to be hospitalized for a day or two.this is really so upsetting for you right now I know buj hopefully she will have to pay you damages fpr all this as it was all her fault.

Awww, Ricki...what a bunch of rotten luck!!! Even though you're in the right, unfortunately it's going to cost you extra money what with having to find transportation and most likely medical problems. I'm so sorry. I was watching a piece on tv last night about distracted driving causing auto accidents. And one of the points made was having kids in the car while driving. So you just found that out, huh? I don't think she has a whisper of a chance of getting out of her responsibility. Hope everything turns out okay for you. Please keep us updated.

OMG, Ricki!! First, OMG that you wrote this waiting in emergency!! Holy cow, I hope you are ok . . . thank goodness you were not hurt more than you were. Sounds like that woman was clearly at fault . . . her "show" will only backfire, especially since you have witnesses. Ahhhhhhhhhhhh, sorry to hear this might be a set back, but yah, things happen. I'll keep my fingers crossed that you heal up soon (that is most important now!).

Ricki I am sorry this happen to you, and I know the stupid lady, that hit you from the side, she is going to pay dearly, the insurance is going to cancelle her after you get paid, this woman won't be able to drive again, after this and when she goes to court, she will really look stupid, you have a witness that saw, the whole thing that is willing to speak up for you, I hope you neck and back will be alright, don't worry about your medical bills, her insurance will have to, take care of that to, and then this woman has accidents, she has been in before, I don't think no insurance company will want to, sign her ever again after, they check her history.

I am so sorry that happened. I hope you do not have too many side effects from the accident. Wouldn't her insurance have to cover your expenses? It sure does throw a monkey wrench into savings plans though. I was making headway, working tons of hours and our van started dying. We located one that we could buy that needed a little work, but less than the one we had, but it took every cent we had just put by.

Oh, dear You definitely did not need this. Does anyone? I hope you're not too physically damaged, that you heal up quickly, and that everything goes well with the insurance claim. Guess Cuba's out of the question for sure.

I just paid my policy on the 16th of this month, so my rates wont go up until next year (thank god). I will let my Dad read everything, seeing as my insurance company will throw me under the bus like last time. I thought it would be worse this morning, but just sore like I exercised and havent in awhile, so hopefully tomorrow is the same. As of now, depends on whether my insurance will give me a new car or not. They better for the thousands I throw into insurance.

Actually, your insurance should cover the medical that you are facing, up to a certain amount this is called personal injury protection and is mandatory to carry in most places (remember I was in an accident during the summer in which both myself and my daughter were hurt). In addition to that, they should pay for you to have a replacement vehicle in the time that it takes you to find a new vehicle or to get your car repaired. Even if they won't give you a rental, they should for your father so that you could drive his car in the mean time or something like that. One other suggestion to you is that you really should go ahead and start consulting with a personal injury attorney. My attorney seems to think that our case is going to settle for over $45,000

If you have all her insurance information, then her insurance should cover all your medical expensive's. Your insurance company should see to this. Since the police were involved I'm sure you have a good case, also with all the witnesses it seems to me you have a solid case. I would not let this go, do not take no or we can't do that for an answer. this woman was clearly in the wrong, make sure you get what you deserve in this matter. If your insurance company will not get you the max then contact a lawyer. There are some law firms out there that will give you advice for free. Make sure you get checked out, because you may have a whip lash injury and sometimes they don't sure up until years later. I know that happened to me. I have to wait for insurance to come in, but here its no fault insurance so my insurance will pay for it. But then my rate go up even if its her fault.

That's nice, people are just too stupid to be careless. They don't care the outcome of what they have done. They must be given a a sample to reckon so do it give him the hell of his wrongdoings.
