If you were setting in chair and a smoker sat near you with his cigarette, do you stay and ask him to move away from you?

Once i was setting in the waiting area, and one guy came and sat in the same area and the smoke of his cigarette was alot, so I asked him to set some where else as I cant smell this smoke, so he apologized and went little away, I was hesitant if its my right to tell him that or no, but then fear for my health pushed me to speak to him, he was gentleman to do that, it happened before and he would not move so I had to move.

I must admit it would be harder for a man to do that to another man not unless their is a definite smoking rule in the particular area

If there are no signs saying "No Smoking" then I will just go away and look for another seat.
