Vulnerability and punishments

Indian government has come up with new penal code.
Rapists can get 20 years or life imprisonment.
Vanny as usual is dissatisfied.
The reason?
Punishment should
a. Prevent similar crimes in future
b. Make the victim feel better
c. Ensure that victim and her family can resume their lives as before or at least as far as possible, the harm is repaired....especially monetarily and socially.
This means, along with 20 years imprisonment .... I am seeking stiff monetary punishment, too.
The other aspect of this law is, they want to give life term or death penalty to the rapists of minors, including those under 18.
Now, me says, vulnerability is not essentially confined to age, though age does play a role.
And death penalty does not deter.... because it cannot be seen. It is implemented behind the prison walls, as is life term.
Therefore, such punishments only become burden for taxpayers as the person remains in prison and we the taxpayers have to pay for their security. Cut the hands from shoulders of the person...that is punishment. And monetary compensation from the rapists and their families. That is punishment.
I am also left wondering about the safety of the people after the 20 years.
So a rapist rapes at say age 21, and comes out from prison at 41. He is young enough to go in search of the victim, and her family and harm them again!
After all, he would not get capital punishment if he has raped an adult.
So ...yeah...still a long way to go to think from our perspectives....
I wish they had put acid attack victims on par with rape victims.

That still leaves the person capable of harming the victim and her family. But removal of arms would make him a liability on his family. I am also told that castrating results in accumulation of hormones that lead to more anger. This would prompt repetition of the crime. Same victim attacked twice, still 20 years?

That's where life after prison needs to be watched. Parole is a good place to start.

It is too much of an effort. With increasing population we must expect more crimes, and therefore, need for more prisons and prison staff. Tall order considering the limited taxes. So yeah...cutting arms will make the guy on par with his victim, and yet render him incapable of another rape. Worth it. I know it sounds inhuman. Yet I am for it...

Castration has two disadvantages.
1. The hormones don't stop. So they lead to anger being built up. That will surface as other forms of cruelty against the victim and her family and even others.
2. It being invisible, many unsuspecting souls may continue to be friends with such criminals only to be caught off guard ...
Sorta potential serial murderers? That can happen with castration.

@BarBaraPrz As I mentioned we forget...once it is done. Whether behind the bars or even others. Missing arms will be perpetual reminder. If the girl is rendered useless due to depression, the guy should become useless too. And when people see him without arms ...they and their kids will talk...and the society will sorta correct itself ...giving right values to kids, whether out of being right, or fear, I don't give a damn. I just want these crimes to stop completely.

Unfortunately, there cannot be a fully satisfying law and justice system
Such a fully satisfying system was never there anywhere in this world not will ever be.
There have always been corrupt people who has taken advantage of loopholes. Sometimes innocents get unfairly punished.
Apart from rape, there are other things like groping, passing lewd comments etc.. How should law deal with these?

@vandana7 Unfortunately there are also good numbers of policemen, lawyers , judges and politicians and others in power who are rapists. When law enforcers themselves commit crime, then the whole thing becomes very difficult.
Many rape cases are hushed up. Especially those which happen within family.

@Bhurishrava We can start with some measures and keep on improving on them, instead of being overwhelmed with the task and spending time only discussing and feeling sorry about the state of affairs. Action is needed, and a few are suggested. It is lawmakers who are avoiding taking such actions.

True that a fully satisfying law and justice system is a myth.
But comparing with the rest of the world is ...demeaning Indian brain. Its like saying, they have to find solutions, we cannot think for ourselves.
If the rape percentage is as high as 1 in every eight minutes, we need to find a way that it comes down to 1 in 30 minutes...that in itself will be a target to focus on. Right? The ineffectiveness of new laws has been clearly proved by the recent Kolkatta, Thane and Dehradun cases.
Obviously 20 years imprisonment doesn't scare anybody.
So why not try serious monetary punishments?

My heart really bleeds for acid attack victims. I am kinda...there are misfortunes on which we have no control, we can never plan for, like earthquakes, riots, wars, pandemics, acid attacks, rapes,.... whatever we can spare is for the unfortunate from such situations, not for people who are careless, don't work, drink, gamble, and overly religious so refuse to follow family planning. In fact, the later lot encroach upon the meager resources we all can spare for the genuinely unfortunate. It makes them what? Sponges.

It should be the punishment mentioned in the book. The moment it is mentioned ..you will see the rapes and gang rapes coming down drastically. It just needs to be suggested...and included in law...the drastic drop in such crimes will be visible even without a single person losing arms. LOL
