How would you go about getting money from a company that never paid you?

I was employed by a photography company for about 6 months. When I quit, they owed me almost $2,000. That was over 6 months ago. They still owe me $1,600. I don't think waiting for the money is working. And bugging them daily isn't working either. But I am also dyslexic and have great difficulty filling out forms and cannot afford to pay any legal fees. Also, this company doesn't have much money. But the company was contracted by a large chain pet store, that definitely has money. They don't care when I complain to them, and they still have a contract with this photo company to work there. Aside from getting someone to beat this guy up, how do I get the money from this horrible company? I know that'll have money after Christmas, because this pet store does photos with Santa and so they'll get a LOT of money from doing that. Now would be an ideal time to somehow get money out of them.

Do not use your dsylexia as an excuse for not completing the appropriate forms necessary to file your claims for money owed you. It may take you a little longer and it may be a little uncomfortable for your eyes, but it will be worth it. Get a friend to help you. Do not allow deadbeat companies to continue to do business and prosper. Go after them. Go after the photography company and the company with whom they had the contract. What this will do is create a problem for the photography company so that no one will want to hire them again. You must have everything well documented so there is no mistake that you did the work and they owe you. Be sure to get your paperwork into the right hands at the main company. If they have a legal department, go there. This is the best way to hurt this photographer. No company wants to hire a company that has trouble with its subcontractors. They contract out to avoid problems. I know this from experience. I owned my own consulting firm for a number of years and won several major contracts with Fortune 500 companies. The last thing in the world I ever wanted was for one of my subcontractors to complain about not getting paid by me. Keep it professional. Don't bad mouth anyone. All you want is your money. Don't even worry about the others who lost their money. They have chosen to move on. Save yourself. Besides, you want to work again. You do not want a reputation for being a trouble maker. Maybe the forms for small claims court are shorter. But I have already attempted the forms for the labor standards board and it just wasn't happening. There were too many forms and it was overwhelming. Believe me, I don't want to allow them to keep doing this to other photographers. They also are harming customers too in many cases, and their BBB rating is now a D because of it. This guy owns the company, so they don't have a legal department. And the other company probably does, but I cannot get through to them. I will ask for that department next time I call to complain though. But all of the photographers have told the company (starts with a P, ends with an O, very large company), and they just don't seem to care at all. This guy has the contract for 3 states! It's crazy. I'm not worried about the others getting their money so much, just that I think they might help me to prove what the amounts were and the payment system since this guy has all of our contracts and we don't have copies. But in emails he has said that what I am telling him that I am owed is correct. I'm already working again, I just won't do photography again. I've heard too many horror stories about other photography companies as well. And the good places out there don't pay enough, but at least I'm sure they probably do pay.

I would approach my local Ministry of Manpower to deal with them. They would have to pay me under the rules of laws.

Find an attorney who doesn't charge a fee unless you win AND collect..you should have brought someone to help you fill out those forms..that would have helped out a lot. Do you have any record whatsoever of you working there..like timecards.. paystubs of any kind..copies of checks.. anything? Any DOCUMENT would help you out.. when it comes to legal matters like this..any good lawyer will tell you YOU NEED PROOF to make [or break] your case..

Checks and dates that were written on them, yes (those dates were never close the date I actually got them, which is when I saw him write them). The last couple times I got paid in cash because I was sick of his checks bouncing. But I recorded that too.

You might be able to contact your local news station too. A lot of times the news station will get involved and pay the legal fees and what not. It doesn't look good for the company image and so, they pay you real quick. Good luck!

I was thinking for company image, the pet store would have wanted to pay me to shut up about this. But they don't even care. The photo company already has a bad image, except in the eyes of the even more unethical pet store that has a contract with them.

I think the best way is to ask them to pay you little by little. I mean $100 here, $100 there etc. If that doesn't work either then ask them to pay you in stuff. I mean machines etc. If they say no again then make them ridiculous to anyone they sign with and you can always go to a special goverment agency to report it

I've been trying for that since May. They've made a couple small payments, but not enough. But now I know they've got a big chunk of money coming to them after the holidays, so I want to be able to get it all. I would take payment in stuff truthfully, because I would use photography equipment. But they don't have stuff either. All the stuff I used was mine.

Take him to small claims court but don't wait too long because there are statutes of limitation. There are several TV small claims courts. You might try applying to all of them and if that doesn't work, just go to your local small claims court. It is possible that you might have to file it first anyway before the TV shows will accept it.

I think I was able to understand what I read on the labor standards board page about the limitation. I have until 2 years after I quit to get my money. But I don't want to wait that long anyway. Where do I go to find which small claims courts I am allowed to apply to?

FYI - if you go to judge judy bring all evidence of the money owed. Then, even if the company still doesn't pay you, her TV show does. (They pay all won claims.) So you'll get your money either way.

Thanks. That's what I've heard, that you'll definitely get your money if you can get on TV. I am definitely trying to get on Judge Judy. But after over 5 months without answers, I'm thinking her people do not find my case interesting enough (I assure you, it would be quite interesting for TV!). Any ideas about other TV judges in the Los Angeles area?

Oh man, that was so bad.. yea i know we all need money for this christmas. maybe you can tell your problem to your country goverment or judge them using law in your country? im not sure they will pay but if you go process it with law I think they will paid you.

My only advice would be to take them to a small claims court. To me it seems like if you don't take some sort of action, then it may be the year 2010 before you see anymore of your money. You need to be aggressive, or threaten them. Tell them that if you don't get your money, you WILL take them to a small claim's court. It should work. An example, I had to pay almost $200 to get my car towed in an error of the salesman who sold me my car. My car has a device so if you dont make your car payment it locks up, but the salesman told me to point the remote at my dashboard and the manual even said that, but you're supposed to point it at the floor. I told them because of their error and the salesman, that costed me $170 to tow my car home cause it wouldn't start, plus my step mom's brother wrote up a fake bill saying he started my car for $50. I told them I wanted my mom (I didn't say it like that though), and I told them I was going to take them to a small claim's court if I didn't get my money. They agreed to foot the bill and take it off the end of the total amount I owe on my car.

1600.00 would qualify for a small claims court suit. You could try that route, I'm sure someone could help you fill out the forms for that. If they don't show up for the hearing, they're automatically in default and the judge rules in your favor. Being a bigger company, they may just blow it off and not show up. You could also try filing a claim with the Department of Labor. Do a search online for them, should have info on their website. I've used them for a similar problem before-actually my employer deducted money out of my check (I was a cashier at a car dealer, and one day my cash drawer was short). But I never authorized them to do that and apparantly they weren't allowed to because the feds got my money back. What ever you decide to do, make sure you have proof of everything, like contracts, pay stubs, time cards, proof you tried calling them-start keeping logs with dates/times etc. You're definitely going to need all that info. The more proof you have in your favor, the better you'll be. Good luck!

They aren't a big company at all, this is a one man operation. He'd probably show up to court, so I'll have to have everything in order for that. I worked in a large chain pet store, but not for them, for this small company that they contract their photography out to. Unless you are suggesting I sue the pet store instead? He never gave pay stubs, just company checks with no cash taken out. This wasn't a time card type of job either. It was working under basically no supervision, but a couple of stores do have a log that I was there. I also don't have a contract because when I signed that, it wasn't a carbon copy thing and so he's got it.

If you have any documentation of hours worked and hours owed you can take them to small claims court. I would suggest documenting your entire work history with these people, hopefully you have copies of your time clock activations etc. For small claims court you don't need an attorney, and can easily represent yourself. The trick is to make sure you can prove they owe you this money.

I have all the days and times I worked recorded and the amount of sales at each location as well (pay is based on commission). I also have every customer's info still saved (phone numbers, addresses, etc.) and they could say I was there and did the work. There wasn't a time clock because I was at a different location each day. I can prove they owe me money.

you know the company ,more than us here ,why you quit you did not tell us ,since you know that they will get a lot of mail during and after xmas ,then wait tell then lets hope they will pay you or contact your human right activist they will help you to get the money

Its horrible when people do this. I had a similar problem, as i do web designing and developing and i completed a site for a small biz, and they never paid me in the end. They changed all the details and i got really upset, because i never got the money. I learnt to always get paid in advanced or atleast pay a 50% deposit. Can you do anything legally? i know its a horrible way to go, but if you win, they will be liable to pay all legal fees involved.

I should be able to do something legally. Whenever they've made a payment, I send them a detailed statement of what they still owe me by email. And amny times they write back something like "okay, we'll make another payment on that amount soon!" or something else that admits I have the amount correct. Other photographers were all given the same rates basically, but they aren't owed enough money to care.

Get someone to help you with the forms - a friend. And then take them to small claims court. You don't need a lawyer for that. Another idea - do you have one of those guys on your local new station that fights injustice -or helps people get their money? There is one on UPN 44 that is a guest. Turn this company over to one of those guys. They may be able to help. Sometimes if you put the company on blast with a local radio station - a dj might help you get your money. That should be a last resort though. I would check Fox 13 or UPN and see if one of their consumer lawyer guys will help. They usually do it for free.

Yes, we have something like that on I think channel 9 news out here or one of the major stations, but it's the local sector of it. I'll definitely try that. Thanks! I bet other former employees would possibly appear on the news for that too.

That's a good idea. I'll see if I can get a complaint into a more major newspaper because this company isn't local to me. This guy covers at least 4 counties in this state and also covers 2 other states. Now that no one will work for him, he's falling pretty behind and maybe soon he'll lose his contract over that. But I was just in one of the pet stores today, and his flyer is up for Christmas. So I took one to have their new 800 number. The pet store didn't know a date yet for the photos.

Contact your local news station. Many have sections to help people who have been taken advantage of. I know ours do here in Florida. If you have a written contract that says how much you were to be paid for your work, then go to small claims court. You have proof that they were to pay you. More then likely just filing notice of it will get them to pay you. If you want a lawyer for it find one that will take it without money up front but only if you win. You can then sue for the 1,600 plus lawyer and court fees not to mention interest etc. Good luck.

Unfortunately, they have the written contract and all the signed forms of employment and all that stuff. :( I don't have copies of that and this guy could have easily "lost" it. That is a good idea about the news station. I will try that and see if other photographers would at least be willing to go on the news, even if they don't care about the money they are owed. I'll see if I can find a lawyer that will take money after if the news thing doesn't work out. I know I could represent myself as far as the arguing goes, but I can barely fill out the forms to do my taxes each year and unless my girlfriend wants to help me with a bunch of forms, I just don't see myself realistically being able to do that.
