Father Kills Mother, Does 10 Months in Jail, Sues for Custody of 4 Year old...

who is being raised by the grandmother. Grandmother has custody of the child and is in hiding from the abusive, alcoholic father of the grandchild. Should a man convicted of killing his wife, be allowed custody of the child? What do you think? I think there's no way the man should have custody of the child.

I don't think he should be able to get the child back. The grandmother should be able to keep custody of the child.

The grandmother has been in hiding to prevent the father from seeing the child, but the father has an attorney and is sueing for custody.

If the man was convicted of killing his child's mother, 10 months in Jail was way to short of a time to pay for it in the first place. No, he should lose all rights to his children. He's already put them through a loss of their mother. The only way I'd reasonably consider the possibility is the actual details of the murder. Was he defending himself from a violent wife, were there odd circumstances involved like DUI in which he killed may have unintentionally killed her. What stumps me is why he only served 10-months for this. Did he maliciously kill her in front of the children? If so, then heck NO.

first of all that man should have never gotten out of jail in ten months! he should still be rotting in there! do you know what state this happened in? second no he shouldnt get any of his father rights, the grandma should have a restraining order on him for his violent history. and they should fight as hard as they can to keep his rights inforced. although this is my oponion, if he got out of jail in ten months for murder whether he was drunk or not, than this state will probably award full custody to the murdering father! this is horrible.

I agree that the man should not have custody of the child. He will try to kill that poor child like what he did to his wife. He should be put behind bars for the rest of his life. Except if he repents, then maybe he should be given the chance to be free. But now at the moment, no way.

that is completely absurd, he should definitely have no right to his child after murdering the mother of the child and I find it unbelievable that he only got 10 months in jail

No way, never, what so he can be a constant reminder of the pain that he's already inflicted on that poor child's life. Where was this, why in the world was this person only given a 10 month jail sentence? Is there more to this story because that doesn't even make sense.

he wasn't fit as a husband and he is not fit as a father. If he couldn't control his temper with an adult. My God what would he do to a child. Ten months that is a joke. what has the world come to where a life is only worth ten monts. Happy new years to you

I cannot see why the guy would already be out of jail after only 10 months. The grandmother should get custody of the child. If he was abusing her while he was drunk and it was an "accident", what is to keep an "accident" from happening to the child? I think the courts would be doing an injustice to the child (more so than the only ten months in jail for the killig of the mother) if the child is put in custody of that man. God help the child.

I don't think he should even have the opportunity to see his daughter. I just hope he doesn't get custody but crazy how the system works he just might. I hope the grandmother remains hidden until her granddaughter gets old enough to take care of herself. I know if I was in that situation I would do the same.

IF THE MAN WAS CONVICTED FOR 10 MONTHS JAIL AND A PERSON WHO HAS KILLED HIS WIFE WOULD NEVER FEEL FREE OR THE CHILD FUTURE WILL NOT BE GOOD HE WILL ALWAYS SEE THE WIFE IN THE CHILDS FACE AND HE MIGHT FEEL GUILTY OF WHT HE HAS DONE WITH HIS WIFE OR VICE VERSA SO IT IS SUGGESTED TO KEEP THE CHILD WITH THE GRAND PARENTS

Why did he only get 10 months in jail for murdering his wife? That makes no sense to me. I would hope the courts wouldn't give the child to him, but courts can be strange sometimes. I worked with 3 little boys who would come to school beaten to a pulp. They admitted it was their mother doing it. We turned them in countless times. Finally they were removed from the home and given to their natural fathers. That was in February. In April they went back to court, and the courts said the father could keep them for the rest of the school year, but that after school was out they all had to go back to their mother. There's no way that woman changed in the less than 2 months between when they gave custody to the dad and the date of the next court appearance. I could not believe it. We lost track of them after they moved away, but I've always wondered if things got ever got any better for those little guys or if mom finally managed to kill one of them.

Personally, I don't even think that there should be a question of custody in this case at all. If the father killed the mother he already doesn't have the child's best interest in heart. A real father would know the close bond that a mother and child share and the fact that he could so easily take away the one person that should mean the most to this child, is enough to prevent him from ever getting custody of that child, again. Of course, the fact that he actually killed someone is another strong factor. I see that you also mentioned something about the grandmother and the child are trying to hide and stay away from the father. I am not sure if there is a restraining order invovled and I know that they don't always stop bad things from happening, but that is one of the first things that should have been done as soon as this guy was let out of prision, even though 10 months is too short of a time. Also, I think that someone should have arranged police protection for this child and her grandmother. I hope everything turns out well for the family that you are talking about.

Yes, there is a restraining order. I agree, if the father had the child's best interest in heart, he wouldn't have harmed the mother!

Respondants to this topic agree the father shouldn't regain custody. So logic says this is a waste of taxpayers' money as to court time; and is therefore, a frivolous lawsuit. Should it be thrown out of court as a frivolous lawsuit? Should laws be changed so murderers are automatically stripped of the rights and responsibilities of their children? I think so.

no,conviction of a crime in general removes the right of parental authority by a parent over a child.that is the law generally accepted internationally.

u also mentioned he's alchoolic. if he killed his wife by accident, with no meaning (car crash or something), then yes the kid should go with him. but if he's alchoolic (no matter what made him start drinking) then no way, he is not able to take care of himself, how can he also take care of his kid?
