Yes IT should be.

No it shouldn't. First there was the push for smokers not to be able to smoke inside and that was accepted but banning smoking in public is going too far. As a matter of interest a Hotel/Bar here in Australia built a special room for smokers, as the law said they couldn't smoke in the bar, and non-smokers are not allowed in that room. :)
