Child support and the Penal system

Does anyone know anything about how to get child support from an incarcerated parent? Or maybe how much my child would be entitled to? I mean, I know that he only makes about $20 per month in there, and I just want to know if you guys think it would be more hassle than its worth.

Is there all ready an order for child support in place? If there is then I think it would just role over into what they all ready ow. If he is only making $20.00 a month then what support of child support would you hope to get? I think it would be more hassle than it is worth at this point in time.

I saw in another post that your ex-inlaws wanted to get "visitation rights" or to have your daughter join them for holidays. Maybe they would be willing to help their son pay the child support. Why don't you set up a meeting with them, let them meet your daughter on regular basis (I would suggest you don't leave her with them in the beginning) and then talk to your ex about the child support. Have him ask his parents if they would be willing to help out.
I would rather try it that way before going through the legal system and suing him for support.
In Iceland, child support is automatically paid through social services unless parents have a written agreement about something else. The parent with the custody gets paid, regardless of weather the other parent pays or not. He/she will eventually have to pay as it's collected through their employer and authorities.

Yes, you can go for the child support and when he gets out he will owe you the money unless he has a saving account or something like that, that he can take the money from now. In addition, you might want to check your state rules, I know many states have special funding programs for childern of incarcerated parents.

I know that u should get an order if u dont have one and once he gets out of jail u can go after him for it. He will have no choice but to get a job and pay u or he will go back to jail for not paying it. and if the child is over 18 once he is out of jail u can still go after him for the back pay as long as a order was in place b4 the child was 18.
