Theft by reciept of property

A person is incarated and they lost his file and now telling him to wait until they recreat the file over. He has no criminal history. But they say this case is a fellony. But they have no proof of any thing. What should we do? I paid a lawyer for a speedy trail and he is not doing anything.

Talk to the lawyer and find out if you can sue them for false imprisonment. Most countries can only hold a person for 72 hours or so without pressing charges of some kind. You don't pay a lawyer for a speedy trial. That is guaranteed under the constitution. You pay a lawyer to protect your rights and to defend you. If your lawyer is not performing contact the bar association to make a complaint.

They say that 72 hours don't exist anymore. And he is being charged. But he is being held under no proof or no grounds. And yes thank you for bar association info I did not thing of that.
